Resource Management Act 1991

Vesting of Land in Ports of Auckland Limited

Pursuant to section 355 (3) of the Resource Management Act 1991, the Minister of Conservation vests the land described in the Schedule hereto in Ports of Auckland Limited, subject to a conservation covenant in terms of section 77 of the Reserves Act 1977, securing the right of public access to the conservation area as well as to the public walkway required to be provided around the Westhaven Boat harbour, being entered into in favour of The Auckland City Council over the area shown as “L” on D.P. 170096, which is to include a 5 metre wide “landscape reserve area”, and more particularly described in clauses (i) and (j) of a consent order, dated 20 December 1991, relating to an appeal in terms of the America’s Cup Planning Act 1989.
