Public Works Act 1981

Land and Easements Acquired for Sewage Treatment Purposes in Waikato District

Pursuant to sections 20 and 28 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for sewage treatment purposes; the right of way easement in perpetuity described in the Second Schedule hereto (being appurtenant to the land acquired described in the First Schedule hereto), is hereby acquired in connection with sewage treatment purposes over the land described in the Third Schedule hereto; and the right to drain sewage easement in perpetuity described in the Fourth Schedule hereto (being appurtenant to the land described in the First Schedule hereto), is hereby acquired in connection with sewage treatment purposes over the land described in the Fifth Schedule hereto; and further declares that the said land and easements shall vest in The Waikato District Council on the date of publication hereof in the New Zealand Gazette.

Land Acquired for Sewage Treatment Purposes

4842 m² Being Part Allotment 886, Taupiri Parish; marked “A” on plan.

13.8275 ha Being Part Section 1, S.O. 59618; marked “B” on plan.

As shown marked as above mentioned on S.O. Plan 60399, lodged in the office of the Chief Surveyor at Hamilton.

Second Schedule

Description of Right of Way Easement

The rights and powers implied in and attaching to a right of way as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right of Way”, as if the same were fully set out herein.

Third Schedule

South Auckland Land District

Land Over Which Right of Way is Acquired

All that piece of land situated in Block XII, Rangiriri Survey District, being part Section 1, S.O. 59618; as shown marked “C” on S.O. Plan 60399, lodged in the office of the Chief Surveyor at Hamilton.

Fourth Schedule

Description of Right to Drain Sewage Easement

The rights and powers implied in and attaching to a right to drain sewage easement as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right to Drain Sewage”, as if the same were fully set out herein.

Land Over Which Right to Drain Sewage Easement is Acquired

All those pieces of land, situated in Block XII, Rangiriri Survey District, being parts of Allotment 812, Taupiri Parish, Section 1, S.O. 59618, Allotment 814, Taupiri Parish, stream bed and Crown land; as shown marked “D”, “E”, “F”, “G” and “H” respectively on S.O. Plan 60399, lodged in the office of the Chief Surveyor at Hamilton.

Dated at Hamilton this 4th day of November 1996.

Land to be Taken for Road in Napier City

MICHAEL HARDIE BOYS, Governor-General

A PROCLAMATION

Pursuant to the Public Works Act 1981, I, the Right Honourable Sir Michael Hardie Boys, Governor-General of New Zealand, hereby declare the land described in the Schedule hereto, to be taken for road and to be vested in The Napier City Council on the 14th day after the date of publication of this Proclamation in the New Zealand Gazette.

Hawke’s Bay Land District

24 square metres, being Lot 2, D.P. 626, Block IV, Heretaunga Survey District; shown marked “A” on S.O. 10651.

S.O. 10651 is lodged in the office of the Chief Surveyor at Napier.

Given under the hand of His Excellency the Governor-General of New Zealand, and issued under the Seal of New Zealand, this 15th day of October 1996.

Amending a Notice Acquiring Land for Road—State Highway 2 Butchers Creek—Dannevirke District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Crown Property Officer, Land Information New Zealand, Napier, hereby amends the notice dated the 5th day of September 1996, published in the New Zealand Gazette of the 12th day of September 1996, No. 115, page 2937, under the heading “Land Acquired for Road—State Highway 2 Butchers Creek—Dannevirke District” by deleting the words “Land Acquired for Road” in the heading and substituting “Land Acquired for a Limited Access Road” and also deleting the recital and substituting the following:

“Pursuant to section 20 (1) of the Public Works Act 1981, section 88 (2) of the Transit New Zealand Act 1989, and to a delegation from the Minister of Lands, the Crown Property Officer, Land Information New Zealand, Napier, declares that the land described in the Schedule to this notice is acquired for limited access road and has become road, limited access road and State highway and vested in the Crown.”
