Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 1992, Amendment No.1 (No. F19)

Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission, and after consideration of the matters specified in section 28W (5) of the said Act, hereby gives the following notice:

N o t i c e

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 1992, Amendment No. 1, and shall be read together with and deemed part of the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 1992 No. 5199 (hereafter referred to as the principal notice).

(2) This notice shall come into effect on the day after its notification in the New Zealand Gazette.

  1. Clause 3 amended—(1) Clause 3 of the principal notice is hereby amended:

(a) By omitting from the table in paragraph (4), opposite the item CRA 6, the expression “.12%”, and substituting the expression “.20.37%”;

(b) By omitting from the table in paragraph (5), opposite the item PAU 4, the expression “.23%”, and substituting the expression “.27.29%”;

(c) By omitting from the table in paragraph (5), opposite the item SCH 4, the expression “.29%”, and substituting the expression “.36.45%”;

(d) By omitting from the table in paragraph (5), the expression “PAU 1C” and substituting the expression “PAU 1”;

(e) By omitting from the table in paragraph (5), the expression “PAU 7C” and substituting the expression “PAU 7”;

(f) By inserting in the table in paragraph (5) in appropriate alphabetical order, the following items:

District Courts Act 1947

District Court Judge Appointed

Pursuant to section 5 of the District Courts Act 1947 and section 28B of the District Courts Act 1947, Her Excellency the Governor-General has been pleased to appoint

Jeremy Paul Doogue, barrister and solicitor of Hamilton to be a District Court Judge, to exercise civil and criminal jurisdiction within New Zealand, and to exercise the criminal jurisdiction of the District Courts under Part IIA of the District Courts Act 1947.

ORDER IN COUNCIL

At Wellington this 19th day of February 1996

Present:
THE RIGHT HON. J. B. BOLGER presiding in Council

WHEREAS—

A. By virtue of certain provisions of the Maori Trust Boards Act 1955, an election of members of the Aupouri Maori Trust Board was held on the 28th day of January 1995; and

B. An irregularity occurred in the sending out of the ballot papers under section 51 of the Maori Trust Boards Act 1955 in that several beneficiaries enrolled in the Ngataki division of the beneficiaries did not receive their ballot papers; and

C. The irregularity affected the result of the election of the two members to represent the Ngataki division of the beneficiaries as the three candidates were separated by one vote each; and

D. It would accordingly not be proper or desirable to validate the irregularity under section 55 of the Maori Trust Boards Act 1955; and

E. It is desirable to declare the election of the members representing the Ngataki division of the beneficiaries to be invalid and to provide for the holding of a fresh election of those members:

NOW THEREFORE, pursuant to section 55A of the Maori Trust Boards Act 1955, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O r d e r

  1. Title and commencement—(1) This order may be cited as the Aupouri Maori Trust Board Order 1996.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. Election of members to represent Ngataki division declared invalid—The election of two members to represent the Ngataki division of the beneficiaries of the Aupouri Maori Trust Board that was held on the 28th day of January 1995 is hereby declared to be invalid.

  2. Provision for fresh election of members to represent Ngataki division—A fresh election of members to represent the Ngataki division of the beneficiaries of the Aupouri Maori Trust Board shall be held in accordance with the following provisions:

(a) The candidates for election for the Ngataki division of the Aupouri Maori Trust Board shall be the same persons as the persons who were candidates for that division at the election held on the 28th day of January 1995:

(b) The Secretary of the Aupouri Maori Trust Board shall, not later than the 1st day of March 1996, post to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election—
