The Treaty of Waitangi Act 1975
State-Owned Enterprises Act 1986

This notice concerns the land at 712 Great South Road, Manukau City, Auckland, and Maori claims under the Treaty of Waitangi Act 1975.

The land at 712 Great South Road, Manukau City, Auckland, is described in legal terms as:

All that parcel of land containing 6290 square metres, more or less, being Lot 1, Deposited Plan 133720 and being part of Clendon’s Grant.

Subject to:

(i) C. 105763.2 application, pursuant to section 25 (1) (a) of the State-Owned Enterprises Act 1986.

(ii) Section 27B of the State-Owned Enterprises Act 1986.

(iii) Mortgage C. 270345.4.

(iv) Mortgage C. 270345.5.

and being comprised in certificate of title 79A/40 (North Auckland Registry).

The land was once owned by the Crown. It was transferred to a State-Owned Enterprise under the State-Owned Enterprises Act 1986.

There is a special notice or “memorial” on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owners of the land, PHILBRI PROPERTIES LIMITED, have applied to the Waitangi Tribunal to have this notice removed. This has been done under section 8D of the Treaty of Waitangi Act 1975.

ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 17TH DAY OF NOVEMBER 1995.

Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington.

The following claims already submitted to the Tribunal may relate to this land:

Wai 30, B. Mhuta, Tainui Maori Trust Board, Tainui lands claim.

Wai 72, Hariata Gordon, Ngati Paoa lands and fisheries claim.

Wai 96, N. Zister, Wairoa and Otau blocks claim.

Wai 121, E. Manukau and T. Paki, Manukau Maori Trust Board, Ngati Whatua lands and fisheries claim.

Wai 276 and Wai 388, R. Grey and others, Ngati Whatua o Orakei Maori Trust Board and Sylvia Park and other Ngati Whatua lands claim.

Wai 330, N. Tupaea and others, Huakina Development Trust, Auckland-South Auckland-Waikato lands claim.

Wai 345, M. and T. Rawiri, Fairburn block claim.

Wai 346, W. Rawiri and D. Steele, Fairburn purchase claim.

If no claim in respect of this land is submitted under section 6 of the Treaty of Waitangi Act 1975, before the date specified in this notice, the Tribunal may recommend that the land or interest in land be no longer liable to resumption under section 27B of the State-Owned Enterprise Act 1986.
