Public Notice of Intention to Take Land for Road—The Hutt City Council

1. Please take notice that under section 23 of the Public Works Act 1981, The Hutt City Council (“the council”) proposes to take under the Public Works Act 1981, those interests in the land described in the Schedule (“the land”).

2. The land is required for roading purposes. It is intended to use the land for part of the ring road system for management of traffic in the central city area, in accordance with designation of the land for that purpose in the council’s transitional and proposed district plans.

3. The owners of the land and those persons with a registered and unregistered interest in it have been served with notice of the council’s intention to take the land and have the right to object to that.

4. Any other person having the right to object may send a written objection to the Registrar, Planning Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington on or before the 7th day of September 1995.

5. If you make an objection:
   (1) You will be advised of the time and place of the hearing; and
   (b) You will have the right to appear and be heard personally or to be represented by a barrister and solicitor or any other person you authorise.

(a) Property 57–61 High Street

(i) An estate in fee simple in that piece of land containing 171 square metres, more or less, being part Section 24, Hutt District, being all the land in certificate of title 425/111, subject to party wall rights in transfer 292243 and mortgage No. B. 437920.2;

(ii) An estate in fee simple in that piece of land containing 207 square metres, more or less, being part Section 24, Hutt District, being all the land in certificate of title 141/167, subject to party wall rights in transfer 292243 and mortgage No. B. 437920.2.

(b) Property 63–69 High Street

An estate in fee simple in that piece of land containing 483 square metres, more or less, being part Lot 4 on Deposited Plan 7974, being all the land in certificate of title 339/165, subject to party wall rights in transfer 292243 and mortgages 965037 and B. 046062.2.

(c) Property 77–81 High Street

An estate in fee simple in that piece of land containing 276 square metres, more or less, being part Lot 2 on Deposited Plan 7974, being all the land in certificate of title 339/166, being defined as area “A” on a survey plan prepared by the council.

(d) Property 83–85 High Street

An estate in fee simple in that piece of land containing 506 square metres, more or less, being part Lot 1 on Deposited Plan 64789, being part of the land in certificate of title 33C/335, subject to transfer 807576.1 and mortgage B. 195167.4 being defined as area “B” on a survey plan prepared by the council.

(e) Property 2 Daly Street

An estate in fee simple in that piece of land containing 237 square metres, more or less, being part Lot 1 on Deposited Plan 19893 and being all the land in certificate of title 770/47, subject to fencing covenant in transfer 302723.
