Securities Act 1978

The Authorised Life Insurance Companies Notice No. 1) 1995

Pursuant to the Securities Act 1978, the Securities Commission gives the following notice:

Notice

1. Title and commencement and expiry—(1) This notice may be cited as the Authorised Life Insurance Companies Notice (No. 1) 1995.

(2) This notice shall come into force on the 1st day of March 1995.

(3) This notice shall expire with the close of the 28th day of February 1996.

2. Interpretation—(1) In this notice “the Act” means the Securities Act 1978.

(2) Any term or expression which is not defined in this notice, but which is defined in the Act, shall have the meaning given to it by the Act.

3. Authorised life insurance companies—Each life insurance company named in the Schedule to this notice is hereby declared to be an authorised life insurance company for the purposes of the Act in respect of all life insurance policies issued by that company.

Notice of Approval of Howard Charles Tonge to Act as a Statutory Supervisor

Pursuant to the Securities Act 1978, the Securities Commission hereby approves Howard Charles Tonge, chartered accountant of Auckland, to act as a statutory supervisor, for the purposes of the Securities Act 1978, in respect of participatory securities in the form of units (“the units”) in Cotswold Bloodstock Limited and Company (“the partnership”) on the following terms and conditions:

(a) That the approval shall expire on 31 August 1996;

(b) That Howard Charles Tonge does not, while holding office as statutory supervisor, hold any appointment (including appointment as auditor) with Cotswold Bloodstock Limited (“the manager”) or any director of the manager or in the partnership;

(c) That Howard Charles Tonge is not, while holding office as statutory supervisor, an employee of the manager or any director of the manager or the partnership;

(d) That Howard Charles Tonge does not, while holding office as statutory supervisor, control or have any right to control directly or indirectly the management or affairs of the manager or any director of the manager or the partnership;

(e) That while Howard Charles Tonge holds office as statutory supervisor, no relationship exists between him and the manager or any director of the manager or the partnership that affects or is likely to affect adversely the exercise of his functions and powers as statutory supervisor;

(f) That while Howard Charles Tonge holds office as statutory supervisor, he maintains professional indemnity insurance in respect of the exercise of his functions and powers as statutory supervisor which he regards as adequate on the basis of independent expert advice.
