Health and Safety in Employment Act 1992

Notice of Intention to Apply for Ministerial Approval of a Code of Practice Under the Health and Safety in Employment Act 1992—Excavations and Safety in Boreholes

Pursuant to section 20 of the Health and Safety in Employment Act 1992, I, Robert J. Hill, General Manager, Occupational Safety and Health Service of the Department of Labour, in exercise of those powers delegated to me by the Secretary of Labour, pursuant to section 41 of the State Sector Act 1988, hereby give notice of my intention, to apply to the Minister of Labour for his approval of a statement of preferred work practices or arrangements for health and safety in excavations and boreholes, as an “Approved Code of Practice”, under the Health and Safety in Employment Act 1992.

These preferred work practices or arrangements describe safety and health precautions that should be taken:

(i) in the construction of excavations, including trenches and open excavations;

(ii) in the construction of shafts and drives; and

(iii) in the construction of large diameter boreholes where persons may enter for inspection or other work purposes.

Traffic Regulations 1976

Exemption From Restrictions Relating to Use of Television Set in Motor Vehicle

Pursuant to regulation 90 (1) of the Traffic Regulations 1976, I, Michael Joseph Small, Senior Vehicle Compliance Officer, hereby exempt the class of vehicle specified in Schedule 1 of this notice from the requirements relating to the operation of television sets in motor vehicles contained within regulation 79 of the Traffic Regulations, subject to the conditions specified in Schedule 2 of this notice.

Schedule 1

Class of Motor Vehicle

One man operated side loading waste collection truck operated by Waste Care Limited.

Schedule 2

Conditions

(1) The close circuit television screen must be turned off at all times the vehicle is being operated at speeds in excess of 20 km/hr;

(2) The close circuit television screen shall only display pictorial images of the side loading bin area of the vehicle.
