Authorisation of the Exchange of Part of a Reserve for Other Land

Revocation of a Reserve

Pursuant to the Reserves Act 1977, and to a delegation
from the Minister of Conservation, the Regional
Conservator, Canterbury, hereby revokes the reservation, as
Local Purpose (Esplanade) Reserve, over the land
described in the Schedule hereto, and further declares that
the said land may be disposed of by the Ashburton District
Council, and any proceeds from the disposal are to be paid into
the council’s Reserve Account, such monies to be used and
applied in or towards the improvement of other reserves
under the control of the Council, or in or towards the
purchase of other land for reserves.

Resource Management Act 1991

Transfer of Esplanade Reserve

Pursuant to section 237D (1) (a) and (b) of the Resource
Management Act 1991, and to a delegation from the
Minister of Conservation, the Acting Regional Conservator,
Auckland Conservancy, Department of Conservation, with
the prior written agreement of The Franklin District
Council, hereby declares that the local purpose (esplanade)
reserve described in the Schedule hereto shall cease to be
vested in and administered by The Franklin District
Council, but instead shall vest in the Crown and be
classified as an historic reserve subject to the Reserves Act
1977 and shall be administered by the Minister of
Conservation in accordance with this classification.
