Notice

1. Title and commencement—

(1) This notice may be cited as the Fisheries (Notification of Proposal To Establish The Waikare Inlet, Waikino And Manaiawoara Creeks As A Taiapure—Local Fishery) Notice 1994.

(2) This notice shall come into effect on the day of its notification in the New Zealand Gazette.

2. Proposal—

(1) A proposal by the Waikare Maori Committee to establish the Waikare Inlet, Waikino and Manaiawoara Creeks as a taiapure—local fishery, has been agreed to in principle by the Minister of Fisheries, after consultation with the Minister of Maori Affairs and after having regard to the provisions of section 54B (3) of the Fisheries Act 1983.

(2) The area that is subject to the proposal is as follows: All that area of water enclosed by a line commencing at Tapu Point (at 35° 18.62'S, 174° 7.43'E), then proceeding in a south-easterly direction along a line to Motukokako Island (at 35° 18.97'S, 174° 7.95'E), thence to a point on the mainland (at 35° 19.0'S, 174° 07.7'E), then proceeding along the line of the mean high water mark including Kaurinui and Waikino Creeks and Waikare Inlet back to the point of commencement.

3. Public inspection of proposal—

(1) A copy of the proposal is available for public inspection, for a period of two months as from the date of publication of this notice in the New Zealand Gazette, at the following addresses:

(a) Maori Land Court, 5–7 Walton Street, P.O. Box 1764, Whangarei;

(b) MAF Fisheries Head Office, ASB Bank House, 101–103 The Terrace, Wellington; MAF Fisheries, 9 Keyte Street, Whangarei;

(c) Far North District Council, Kawakawa Service Centre, Main Road, Kawakawa;

(d) Northland Regional Council, Quay Street, Whangarei.

4. Objections to, and submissions on, proposal—

(1) Any person who is or may be affected by any aspect of the proposed taiapure—local fishery may by 4 October 1994, being two months from the date of publication of this notice in the New Zealand Gazette, lodge an objection to, and/or submission on the proposal at the office of the Maori Land Court given above.

(2) All objections and submissions on the proposal shall:

(a) Identify the grounds on which the objections or submissions are made; and

(b) Be supplemented by such particulars or information as the Registrar of the Maori Land Court notifies the applicant, that the Registrar of the Maori Land Court considers necessary to sufficiently identify the grounds for the objections or submissions.

Fisheries (Notification of Proposal To Establish The Maketu And Waihi Estuaries, And A Coastal Strip From Wairakeito Otamarakau As A Taiapure—Local Fishery) Notice 1994

Pursuant to section 54D (2) of the Fisheries Act 1983, the Director-General of Agriculture and Fisheries, acting under an authorisation from the Minister of Fisheries, hereby gives the following notice:

1. Title and commencement—

(1) This notice may be cited as the Fisheries (Notification of Proposal To Establish The Maketu And Waihi Estuaries, And A Coastal Strip From Wairakeito Otamarakau As A Taiapure—Local Fishery) Notice 1994.

(2) This notice shall come into effect on the day of its notification in the New Zealand Gazette.

2. Proposal—

(1) A proposal by Te Ihu o te Waka ki Maketu to establish the Maketu and Waihi Estuaries, and a coastal strip from Wairakeito Otamarakau as a taiapure—local fishery, has been agreed to in principle by the Minister of Fisheries, after consultation with the Minister of Maori Affairs and after having regard to the provisions of section 54B (3) of the Fisheries Act 1983.

(2) The area that is subject to the proposal is as follows: That portion of New Zealand Fisheries Waters enclosed by a line commencing at the original mouth of the Wairake Stream at the north western corner of Taylor Reserve, Papamoa (at 37° 42.65'S and 176° 20.02'E), then running to a point (at 37° 42.15'S, 176° 20.42'E), then running generally parallel to mean high water mark to a point (at 37° 44.85'S, 176° 26.20'E), then running as part of the circumference of a circle with its centre at Okurei Point (at 37° 44.67'S, 176° 28.27'E), with a radius of 3000 metres to a point (at 37° 45.62'S, 176° 29.92'E), then running generally parallel to mean high water mark to a point (at 37° 49.46'S, 176° 35.91'E), then running to a point (at 37° 50.20'S, 176° 36.05'E) at the mean high water mark, then running along the mean high water mark including the tidal waters of Waihi Estuary and Maketu Estuary to the point of commencement.

(c) Western Bay District Council, Cameron Road, Barkes Corner, Greerton;

(d) Bay of Plenty Regional Council, Quay Street, Whakatane.
