Conservation Act 1987

Declaring Land to be Held for Conservation Purposes Together With a Declaration That the Area Become a Local Purpose Reserve

Pursuant to section 7 (1) of the Conservation Act 1987, the Minister of Conservation and the Minister of Lands, being the Minister responsible for the Department of State that has control of the land described in the Schedule hereto, jointly declare that the land is held for conservation purposes and pursuant to section 8 (1A) of the Act, the Minister of Conservation further declares that the conservation area shall hereafter be set apart as a reserve, subject to the Reserves Act 1977, classified as a local purpose (community building) reserve, and further declares that, pursuant to section 26 of the latter Act, the reserve be vested in The Tasman District Council in trust for that purpose.

Schedule

2295 square metres, more or less, being Section 1, S.O. Plan 15080, situated in Block I, Waimea Survey District.

Declaring Land to be Held for Conservation Purposes

Land Act 1948

Reservation of Land

Pursuant to section 167 of the Land Act 1948, the Minister of Conservation, with the consent of the Minister of Lands, hereby sets apart the lands described in the Schedule hereto, as reserves for the purposes specified at the end of the respective descriptions of the said lands, subject to the provisions of the said Act.

Schedule

Nelson Land District—Tasman District

32.000 hectares, more or less, being Section 1, S.O. Plan 15147, situated in Block V, Pakawau Survey District (Government purpose (wildlife management) reserve).

51.000 hectares, more or less, being Section 2, S.O. Plan 15147, situated in Block IV, Pakawau Survey District (Scenic reserve).

Reserves Act 1977

Authorisation of the Exchange of Part of a Reserve for Other Land

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator, Auckland Conservancy, Department of Conservation, hereby authorises the exchange of that part of the local purpose (community buildings) reserve described in the First Schedule hereto, for the land described in the Second Schedule hereto.

First Schedule

North Auckland Land District—Manukau City

1424 square metres, more or less, being Lot 2, D.P. 160221. Part certificate of title 47A/1201. Subject to a right of way easement created by 869545.4 which is subject to section 309 (1) (a) of the Local Government Act 1974.

Second Schedule

North Auckland Land District—Manukau City

3044 square metres, more or less, being Lot 1, D.P. 160221. Part certificate of title 71A/679. Subject to section 59 of the Land Act 1948. Subject to a right of way easement created by 869545.4 which is subject to section 309 (1) (a) of the Local Government Act 1974. Part certificate of title 47B/111.

All situated in Block XIII, Otahuhu Survey District.

Classification and Naming of a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator for the Bay of Plenty Conservancy of the Department of Conservation, hereby classifies the reserve described in the Schedule hereto, as a recreation reserve, subject to the provisions of the said Act, and further, declares the said reserve shall hereafter be known as the Pohutukawa Park Recreation Reserve.
