No. 45

Road Realignment (State Highway No. 1) in the Rangitikei District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Survey and Land Information, Wellington:

(a) Pursuant to section 114 (1) of the Public Works Act 1981 and section 88 (2) of the Transit New Zealand Act 1989, declares the land described in the First Schedule to this notice to be limited access road and has become road, vested in the Crown on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to sections 116 (1), 117 and 120 (3), declares the portion of road described in the Second Schedule to this notice to be stopped and amalgamated with the land in certificate of title, No. B4/1020, subject to the grant of water and incidental rights contained in transfer 688715, memorandum of mortgage 689819.3 and open space covenant B312675.2.

(c) Declares the land described in the Third Schedule to this notice to be taken under section 119 (1) and amalgamated with the land in certificate of title, No. B4/1020 subject to the grant of water and incidental rights contained in transfer 688715, memorandum of mortgage 689819.3 and open space covenant B312675.2.

Land Declared to be Road, Road Stopped and Land Severed by Road—Ngapaeruru Road, Dannevirke District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to be road that shall vest in The Tararua District Council.

(b) Pursuant to sections 116 (1) and 117 (3), declares the road described in the Second Schedule to be stopped, and further declares:

(i) The areas marked “F”, “G”, “J” and “K” (now known respectively as Section 17, S.O. 8394 and Sections 12, 13 and 14, S.O. 8393) shall be amalgamated with the land in certificate of title D4/53, subject to mortgage No. 585524.3.

(ii) The areas marked “H” and “I” (now known respectively as Section 18, S.O. 8394 and Section 15, S.O. 8393) shall be amalgamated with the land in certificate of title B1/512, subject to mortgage No. 4655880.1 and 332469.2 and encumbrance No. 332469.1.

(c) Declares the land described in the Third Schedule (now known as Section 16, S.O. 8393) to be taken under section 119 (1) and shall be amalgamated with the land in certificate of title D4/53, subject to mortgage No. 585524.3.
