(2) This notice shall come into force on the day after the date of its notification in the New Zealand Gazette.

  1. Amendment notice 1993 (Ag. 12/2/14; No. 5310) is hereby amended by inserting the words “and regulation 16” after the words “pursuant to regulation 13”.

  2. Schedule One—Clause 3.7 of the principal notice is hereby revoked and the following clause substituted in its place:

“3.7 ‘Sunburn’ means an injury from exposure to the sun, expressed as concentrated bleached scorched patches on the skin surface, resulting in discoloured and/or damaged flesh.”

Insert an additional clause:

“3.10 ‘Blemish’ means any superficial mark on the skin which has not broken the skins surface”.

  1. Schedule Two—The note to clause 5.1 of the principal notice is hereby revoked and the following note substituted in its place:

“Note: Fruit in the size range of 1 kg up to 1.2 kg only is permitted as a separate pack, which shall be marked ‘S’ and/or ‘1 - 1.2 kg’, and checked for maturity prior to export.”

  1. Schedule Three—Insert an additional clause:

“6.12 ‘Blemish’ the aggregate area of blemish shall not exceed 4 square cm in area”.

Dumping and Countervailing Duties Act 1988

Notice of Review of Need for Continued Imposition of Anti-Dumping Duty on Certain Men’s Footwear from China, Indonesia, Korea, Taiwan and Thailand

I hereby give notice that, pursuant to section 14 (5) of the Dumping and Countervailing Duties Act 1988, I have initiated a review of the need for the continued imposition of anti-dumping duty on goods specified in the Schedule to this notice. Anti-dumping duty was imposed on these goods in a notice dated 11 September 1992, and published in the New Zealand Gazette of 17 September 1992.

Schedule

Goods Subject to Review

Country of Origin: China, Indonesia, Korea, Taiwan and Thailand.

Description of Goods: Certain men’s shoes (including unisex shoes), including sports casual shoes but excluding the following categories:

  • Men’s and boy’s shoes, size 4 and below.

  • Sports footwear:
    (a) footwear which is designed for a sporting activity and has, or has provision for the attachment of spikes, sprigs, stops, clips, bars or the like; and
    (b) skating boots, ski-boots and cross-country ski footwear, wrestling boots, boxing boots and cycling shoes.

  • Sandals and similar open-toed footwear with straps across the instep.

  • Slippers.

  • Footwear with upper straps or thongs assembled to the sole by means of plugs.

  • Footwear incorporating a protective metal toe cap.

  • Footwear with outer soles of leather.

  • Footwear made on a base or platform of wood.

  • Footwear containing woolskin.

  • Thong type products.

  • Industrial safety toe type.

  • Diving boots.

  • Waterproof footwear with outer soles and uppers of rubber or of plastics, the uppers of which are neither fixed to the sole nor assembled by stitching, riveting, nailing, screwing, plugging or similar processes.

The goods are currently classified under the following Tariff Items and Statistical Keys of the Tariff of New Zealand:
