Securities Amendment Act 1988

The Authorised Futures Dealers Notice 1994

(No. 12)

Pursuant to the Securities Amendment Act 1988, the Securities Commission gives the following notice:

Notice

1. Title and commencement—(1) This notice may be cited as the Authorised Futures Dealers Notice 1994 (No. 12).

(2) This notice shall come into force on the day after the date of its publication in the New Zealand Gazette.

2. Interpretation—(1) In this notice, unless the context otherwise requires,—

“the Act” means the Securities Amendment Act 1988.

(2) Any term or expression that is not defined in this notice, but that is defined in the Act, has the meaning given to it by the Act.

3. Tower Corporation Holdings Limited authorised to carry on the business of dealing in futures contracts—(1) Tower Corporation Holdings Limited is authorised to carry on the business of dealing in futures contracts made on or effected through:

(a) An authorised futures exchange; or

(b) A futures exchange in a country other than New Zealand which is authorised by the laws of that country to operate as a futures exchange.

(2) The authorisation of Tower Corporation Holdings Limited referred to in subclause (1) of this clause is subject to the condition that Tower Corporation Holdings Limited does not carry on the business of dealing in futures contracts except:

(a) As part of the business of Tower Corporation Holdings Limited as a funds manager; or

(b) As part of the duties and functions of Tower Corporation Holdings Limited as a trustee of any managed funds.

(3) The authorisation granted by subclause (1) of this clause shall continue in force until it is revoked by the Commission.

Conservation

Conservation Act 1987

Amendment to Notice Relating to An Exchange of a Conservation Area

Pursuant to section 50A of the Conservation Act 1987, the Minister of Conservation hereby amends an error in the notice authorising the exchange of conservation area dated 9 June 1994 and published in the New Zealand Gazette of 16 June 1994, page 1973, by omitting from the Second Schedule of the said notice “All” and inserting in its place “Part”.

Reserves Act 1977

Authorisation of the Exchange of Part of a Reserve for Other Land

Pursuant to the Reserves Act 1977, and a delegation from the Minister of Conservation, the Regional Conservator, Canterbury, hereby authorises the exchange of that part of Raukapuka Recreation Reserve described in the First Schedule hereto, for the land described in the Second Schedule hereto.

Classification of Reserve and Declaration That the Reserve be Part of the Kaiteriteri Recreation Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator of the Nelson/Marlborough Conservancy of the Department of Conservation, hereby classifies the reserve described in the Schedule hereto, as a recreation reserve, and further, declares the said reserve to form part of the Kaiteriteri Recreation Reserve to be administered as a recreation reserve by the Kaiteriteri Recreation Reserve Board.
