Traffic Regulations 1976

Exemption of ATV's from Motor Vehicle Equipment and Inspection Requirements When Registered Exempt Class A Vehicle

Pursuant to regulation 90 of the Traffic Regulations 1976 and pursuant to the powers delegated to me by the Secretary for Transport, I, Hugh Cameron Matheson, Senior Automotive Engineer, hereby exempt from the requirements of regulations 84 (6) and 85 (1) of the said regulations the class of vehicle specified in the Schedule hereunder subject to the conditions specified in the Schedule.

Schedule

The class of vehicle is an all terrain vehicle (ATV) which complies with the following descriptions:

  1. A special purpose motor vehicle which has three or more wheels, is principally designed for off-road use, and

(i) has a gross vehicle mass of less than 1000 kilograms, and

(ii) has an engine cylinder capacity exceeding 50 millilitres, and

(iii) may be fitted with motorcycle controls and equipment.

  1. Conditions

(i) The ATV is used on a road which is not a public highway and qualifies for an exemption from registration and licensing fees in accordance with Part II of the First Schedule to the Transport (Vehicle and Driver Registration and Licensing) Act 1986 (Registered in EA category—Exempt Class A Licence Label).

(ii) When operated on any road/public highway the operator shall ensure the vehicle complies with those parts of the following regulations which pertain to a motor cycle; regulations 62, clause 3A, 68, 69, 70, 77, 80, 81, 82A and 83 of the Traffic Regulations 1976. The brake system shall also include an efficient locking device for parking purposes.

(iii) When operated on any road/public highway during the hours of darkness, the lighting requirement specified in regulation 37, clause 8 of the Traffic Regulations 1976 shall be complied with.

(iv) The ATV must not be operated at a speed exceeding 30 kilometres per hour on any road/public highway.
