Exemption of ATV’s from Motor Vehicle Equipment and Inspection Requirements When Registered Exempt Class B Vehicle

Pursuant to regulation 90 of the Traffic Regulations 1976 and pursuant to the powers delegated to me by the Secretary for Transport, I, Hugh Cameron Matheson, Senior Automotive Engineer, hereby exempt from the requirements of regulations 84 (6) and 85 (1) of the said regulations the class of vehicle specified in the Schedule hereunder subject to the conditions in the Schedule.

Schedule

The class of vehicle is an all terrain vehicle (ATV) which complies with the following descriptions:

  1. A special purpose motor vehicle which has three or more wheels, is principally designed for off-road use, and

(i) has a gross vehicle mass of less than 1000 kilograms, and

(ii) has an engine cylinder capacity exceeding 50 millilitres, and

(iii) may be fitted with motorcycle controls and equipment.

  1. Conditions

(i) The ATV must be owned by a farmer for farm purposes thus qualifying as a farm vehicle in accordance with the First Schedule to the Motor Spirits Duty Refund Regulations 1978 (Registered in EB category—Exempt Class B Licence Label).

(ii) When operated on any road/public highway during the hours of daylight, the operator shall ensure the vehicle complies with those parts of the following regulations which pertain to a motor cycle. Regulations 62, clause 3A, 68, 69, 70 clause 4 and 5, 71 clauses 1 and 2, 76 clause 1 and the second paragraph to clause 2, 77, 80, 81, 82A and 83 of the Traffic Regulations 1976.

(iii) When operated on any road/public highway during the hours of darkness, the operator shall ensure the vehicle complies with, in addition to conditions in (ii), those parts in regulations 58, 59, 60, 62 clause 1, and 63 which pertain to a motor cycle.

(iv) When the driver’s arm signals are obscured, the operator shall ensure the vehicle complies with regulations 61 and 63, which pertain to a motor cycle.

(v) When auxiliary lamps are fitted, the operator shall ensure the respective requirement in regulation 65 are complied with.

(vi) If a windscreen is fitted, the requirements in regulation 73 must be complied with which pertain to a motor cycle.

(vii) The ATV must not be operated at a speed exceeding 30 kilometres per hour on any road/public highway.

Transport (Vehicle Standards) Regulations 1990

Exemption of ATV’s from the Equipment Requirements of the Transport (Vehicle Standards) Regulations 1990

Pursuant to regulation 36 of the Transport (Vehicle Standards) Regulations 1990, and in exercise of powers delegated to me, pursuant to section 41 (1) of the State Sector Act 1988, I, Hugh Cameron Matheson, Senior Automotive Engineer, hereby exempt the motor vehicles as specified in Schedule 1 below from the provisions of the Transport (Vehicle Standards) Regulations 1990, subject to compliance with the conditions listed in Schedule 2 below.

Schedule 1

The class of vehicle is an all terrain vehicle (ATV) which complies with the following description.

A special purpose vehicle which has three or more wheels, is principally designed for off-road use, and

(i) has a gross vehicle mass of less than 1000 kilograms, and

(ii) has an engine cylinder capacity exceeding 50 millilitres, and

(iii) may be fitted with motorcycle controls and equipment.

Schedule 2

ATV’s must only be registered in either EA or EB category allowing only limited public highway use.

Transport (Vehicle and Driver Registration and Licensing) Act 1986

Approval of Course in Map Reading

Pursuant to section 48 (2) (a) of the Transport (Vehicle and Driver Registration and Licensing) Act 1986, and pursuant to a delegation given by the Secretary for Transport in an instrument dated the 16th day of November 1992, I, Warren Gillespie Simeon, Manager, Road User Standards, hereby approve the following organisation to conduct a course in map reading for the purposes of regulation 11 (1) (c) of the Transport (Drivers Licensing) Regulations 1987:

K-K Driving School, Auckland.
