The Local Government (Southland Harbour Board Property) Reorganisation Order (No. 2) 1993

ORDER IN COUNCIL

At Wellington this 8th day of March 1993

Present:
Her EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

Pursuant to section 8 of the Local Authority Reorganisation (Property Transfers) Act 1990, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O r d e r

  1. Title and Commencement—(1) This order may be cited as The Local Government (Southland Harbour Board Property) Reorganisation Order (No. 2) 1993.

(2) This order shall come into force on the 28th day after the date of its notification in the Gazette.

(3) The Southland Harbour Board referred to in this order was a local authority dissolved on 1 November 1989 under section 36 of the Local Government Act 1974.

  1. Vesting of Property—The Port Company Plan prepared pursuant to the provisions of the Port Companies Act 1988 by the Southland Harbour Board in respect to its port related commercial undertaking, and approved by the Minister of Transport with amendments on the 6th day of December 1988, shall continue in effect but is hereby modified to the extent that the provisions in that part of paragraph (b) on page 6 of the Plan providing for the satisfaction of the debt owing by the Southland Harbour Board for the purchase of the port related commercial undertaking, commencing with the words “To satisfy the purchase price ...”, is deleted and the following is substituted:

“To satisfy the purchase price of the assets it is recommended that the Port Company issue to the Board:

(i) 30 million class A shares of $0.50 par value = $15 million

(ii) debt securities of $8 million value to secure the repayment of the Board’s debts = $8 million

Total cost of assets = $23 million”.
