Schedule Two

Part Inserted into Principal Notice:

"Notwithstanding anything to the contrary in this notice live in-shell dredge or Bluff oysters may be moved into and from the areas described in the Schedules to this notice provided that:

(i) the oysters intended to be moved come from an area which is to the satisfaction of the manager, Marine Research, MAF Fisheries, free of Bonamia sp;

(ii) the movement of the oysters is in accordance with a protocol, approved by the manager, Marine Research, MAF Fisheries and designed to minimise the risk of any previously undetected Bonamia sp from being transferred with the oysters;

(iii) the oysters shall not be moved into an area in which there are substantial stocks of oysters not affected with or harbouring Bonamia sp; and

(iv) the oysters shall not be moved without permission of the Group Director MAF Fisheries or the Regional Manager, MAF Fisheries, of the area into which it is intended the oysters be moved."

Temporary Safeguard Authorities Act 1987

Statement of Government Policy in Relation to the Tyre Industry

To: Temporary Safeguard Authority

Pursuant to section 6 (1) (d) of the Temporary Safeguard Authorities Act 1987, I, Philip Burdon, Minister of Commerce advise that, in considering whether an industry has suffered or is likely to suffer material injury as a result of the importation of used tyres, you should have regard to the following Government policies:

Levels of industry assistance are being progressively reduced to encourage greater levels of international competitiveness.

In relation to tyres, this policy has been reflected in the removal of import licensing on 1 April 1989 and the staged reduction of the ad valorem duty from 22.5 percent in 1991 to 15 percent by 1 July 1996. The level of industry assistance afforded the tyre industry is scheduled for review in 1994.

The determination of any injury and any appropriate temporary remedies should be compatible with New Zealand’s international obligations under Australia New Zealand Closer Economic Relations Trade Agreement (ANZCERTA), the South Pacific Regional Trade and Economic Cooperation Agreement (SPARTECA) and the General Agreement on Tariffs and Trade (GATT).

Pursuant to section 5 (1) of the Temporary Safeguard Authorities Act 1987 (“the Act”), I, Philip Burdon, Minister of Commerce, request you to undertake an inquiry into the importation of the goods specified in the Schedule to this request (“the goods”) and report on the following matters:

(a) Whether the industry in relation to the goods has suffered or is likely to suffer material injury as a result of the importation of goods having regard to the matters set out in section 6 of the Act; and
