Road Realignment in Western Bay of Plenty District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Western Bay of Plenty District Council.

(b) Pursuant to sections 116 and 117, declares the pieces of road described in the Second Schedule hereto to be stopped and that:

(i) Area "B", now known as Section 1, S.O. 53639, shall be amalgamated with the land in certificate of title No. 25D/329, subject to memoranda of mortgage H. 355017.2 and B. 062598.2, and to caveat H. 476323, South Auckland Land Registry.

(ii) Area "C", now known as Section 2, S.O. 53639, shall be amalgamated with the land in certificate of title No. 28A/1178, subject to memoranda of mortgage H. 355017.2 and B. 062598.2, and to caveat H. 476323, South Auckland Land Registry.

As shown marked as above mentioned on S.O. Plan 53639, lodged in the office of the Chief Surveyor at Hamilton.

Second Schedule

As shown marked as above mentioned on S.O. Plan 53639, lodged in the office of the Chief Surveyor at Hamilton.

Land Acquired and Set Apart for Service Lane, Edwardes Street, Napier City

Pursuant to the Public Works Act 1981 and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier:

(a) Pursuant to section 52 (4) and at the request of The Napier City Council declares the land held by the council in fee simple described in the First Schedule hereto to be set apart for a service lane.

(b) Pursuant to section 20 (1) an agreement to that effect having been entered into declares the land described in the Second Schedule to be acquired for service lane which shall vest in The Napier City Council on the date of publication in the Gazette.

Land Acquired for Soil Conservation and River Control Purposes, Moteo Stopbank, Hastings District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that, an agreement to that effect having been entered into, the land described in the Schedule is acquired for soil conservation and river control purposes and shall vest in The Hawke’s Bay Regional Council on the date of publication in the Gazette.
