All New Zealand fisheries waters enclosed by a line commencing at 42° 10' S and 176° 00' E; then proceeding due east to the outer limits of the exclusive economic zone along the latitude 42° 10' S; then proceeding in a generally southerly direction along the outer limits of the exclusive economic zone to a latitude of 46° 00' S; then proceeding due west to the point 46° 00' S and 176° 00' E; and then proceeding in a northerly direction to the point of commencement; and including all those inland waters that flow into this area and that part of their catchments.

Cape Palliser to Cape Terawhiti

All New Zealand fisheries waters enclosed by a line commencing at Cape Palliser on the south coast of the North Island (at 41° 37' S and 175° 17' E); then proceeding due south along longitude 175° 17' E to the 42° 10' S parallel of latitude; then due west along latitude 42° 10' S to the 174° 42' E line of longitude; then proceeding in a north-westerly direction to a point 41° 17' S and 174° 29.4' E; then proceeding due east to Cape Terawhiti on the south coast of the North Island (at 41° 17' S and 174° 36.6' E); then proceeding in a generally easterly direction along the mean high-water mark to the point of commencement; and including all those inland waters west and south of a line commencing at Cape Palliser on the south coast of the North Island (at 41° 37' S and 175° 17' E) proceeding in a generally north-westerly direction to a point 41° 0' 0.0" S and 175° 23' E; then proceeding in a generally south-westerly direction to Cape Terawhiti on the south coast of the North Island (at 41° 17' S and 174° 37' E).

All New Zealand fisheries waters enclosed by a line commencing at the light on Separation Point on the north coast of the South Island (at 40° 47.0' S and 172° 59.9' E); then proceeding in a northerly direction to the light on Bush End Point on Farewell Spit at 40° 32.9' S and 173° 00.6' E; then proceeding in a generally west and south direction along the mean high-water mark to the point of commencement; and including all those inland waters that flow into this area and that part of their catchments that are north of a line commencing at Clarence Point on the east coast of the South Island (at 42° 10' S and 173° 56' E) and proceeding south west to Awaroa Point on the west coast of the South Island (at 44° 16' S and 168° 03' E).

Fisheries Act 1983

Fisheries (Bycatch Trade-Off) Notice 1992, No. 2 (No. 5185)

Pursuant to section 28zg of the Fisheries Act 1983, and delegation made pursuant to section 41 of the State Sector Act 1988, the Acting Director (Operations), MAF Fisheries hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Bycatch Trade-off) Notice 1992, No. 2.

(2) This notice shall come into effect on the 1st day of November 1992, and shall expire on the 30th day of September 1993.

  1. Interpretation—In this notice:

(a) Any reference to Quota Management Area means the appropriate Quota Management Area as defined in the Fisheries (Quota Management Areas, Total Allowable Catches and Catch History) Notice 1986;

(b) Target species and bycatch species are specified by way of fishstock codes, being Fishstock Codes defined in the Second Schedule of the Fisheries (Reporting) Regulations 1990; and

(c) Methods are specified by way of method codes, being Method Codes defined in the Second Schedule of the Fisheries (Reporting) Regulations 1990.

  1. Offering a lease of quota in lieu of paying deemed value—As from the date this notice comes into effect, any commercial fisherman who could be required under section 28zd of the Fisheries Act 1983 to pay the deemed value of any fish that is specified as a bycatch species in this notice, may offer the Director-General a lease or sublease of the right to take fish, being fish that are specified in this notice as a target species in relation to that bycatch species, as specified in the tables below. The ratios, as specified, are the amounts of target species which may, in lieu of such payments, be accepted by way of lease or sublease in relation to the amount of the bycatch species for which the offer of quota is made, e.g., if a fisher could be required to pay deemed value for 1 tonne of ELE 3 and wishes to offer a lease of SCH 3 then the amount that can be offered is 1 tonne x 2.07 = 2.07 tonnes of SCH 3. The bycatch species must have been taken while fishing for the target species using the method or any of the methods specified.
