Pursuant to section 4 (4) of the Forest and Rural Fires Act 1977, the National Rural Fire Authority hereby makes the following notice.

This notice shall come into force on the 28th day after notification in the New Zealand Gazette.

2. Abolition of Rural Fire District

The Fairlie Defence Rural Fire District Notice 1986 (a) is hereby revoked.

Overseas Investment Regulations 1985

The Overseas Investment Exemption Notice 1992, No. 1

Pursuant to the Overseas Investment Regulations 1985, the Overseas Investment Commission hereby gives the following notice.

Notice

1. Title and commencement

(1) This notice may be cited as the Overseas Investment Exemption Notice 1992, No. 1.

(2) This notice shall come into force on the day after the date of its notification in the Gazette.

2. Interpretation

(1) In this notice, unless the context otherwise requires—

“Specified person” means any company which is an overseas person but which would not be an overseas person if Brierley Investments Limited were not an overseas person.

“The regulations” means the Overseas Investment Regulations 1985.

(2) Terms or expressions used in this notice shall have the same meaning as they have in the regulations.

3. Exemption from Part I of the regulations

Every person is exempt from the provisions of Part I of the regulations in respect of the issue of shares to, or the allotment of shares subscribed for by—

(a) A specified person; or

(b) Brierley Investments Limited.

4. Exemption from Parts II and III of the regulations

(1) Brierley Investments Limited and every specified person is exempt from the provisions of Part II (except regulation 16) and Part III of the Regulations.

(2) Every person is exempt from the provisions of regulation 16 of the regulations in respect of the provision of any contract or agreement which provides for the transfer of shares in a company to:

(a) A specified person; or

(b) Brierley Investments Limited.

Explanatory Note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, exempts persons who issue or allot shares to any specified person, or to Brierley Investments Limited from Part I of the Overseas Investment Regulations 1985. The term “specified person” is defined to mean a company which is an overseas person under the regulations but which would not be an overseas person if Brierley Investments Limited were not an overseas person.

The notice exempts Brierley Investments Limited and specified persons from the requirements of Part II (except regulation 16) of the regulations (which relates to takeovers by overseas persons) and from Part III of the regulations (which relates to the acquisition by an overseas person of assets used in carrying on a business).

The notice also exempts persons from compliance with regulation 16 in relation to any contract or agreement which provides for the transfer of shares in a company to a specified person or to Brierley Investments Limited.

Notice of Approval to Act as Statutory Supervisor

Pursuant to the Securities Act 1978, the Securities Commission hereby approves James Bryant Steele of Wellington, chartered accountant, to act as a statutory supervisor, for the purposes of the Securities Act 1978, in respect of the issue by Bowen Hospital Charitable Trust (referred to in this notice as “the trust”), of participatory securities in respect of a scheme for the disposition of units in a complex that provides or is intended to provide residential accommodation for persons in their retirement (referred to in this notice as “the scheme”), on the following terms and conditions:

(a) That the approval shall expire at the end of 5 years from the date of this notice;

(b) That James Bryant Steele does not, while holding office as statutory supervisor, hold any office or appointment (including appointment as auditor) in the trust or in respect of the scheme;

(c) That James Bryant Steele is not, while holding office as statutory supervisor, an employee of the trust;

(d) That James Bryant Steele does not have, while holding office as statutory supervisor, control or have any right to control directly or indirectly the management or affairs of the trust or
