easement temporarily from time to time to allow for a more practical route if and where ground conditions, contour, or livestock location so require provided that in exercising its rights herein the Crown shall:

(a) bear all costs;

(b) at all times repair and maintain such cable, cables, conducting media, structures and associated works as may be constructed or laid through or under that part of the servient tenement in pursuance of these presents in a good and efficient state of repair for the purposes for which the same are designed and will prevent the same from becoming a nuisance;

(c) take all reasonable steps to prevent damage being caused to the servient tenement and the surrounding park land;

(d) promptly restore at its own expense the servient tenement and surrounding park land affected by such works to condition existing before entry, or alternatively, at the option of the Minister of Lands, the Crown may compensate the owner for any damage;

(e) appoint a representative to consult regularly with a nominee of the Director of Parks, Auckland Regional Council, concerning the following matters:

(i) the question of park security in respect of Shakespeare Regional Park;
(ii) the issue of park gate keys, and;
(iii) such other matters in respect of Shakespeare Regional Park as may concern the owner, and;

(f) shall take all reasonable steps to advise the owner in the event that the Crown wishes to use the said easements outside the hours of eight (8) a.m. to five (5) p.m., Monday to Friday.

  1. The owner shall:

(a) not erect or permit to be erected any building structure or structures or plant or permit to be planted any trees on the servient tenement;

(b) do permit or suffer any act whereby the rights, powers, licences and liberties herein granted to the Crown may be interfered with or affected; or,

(c) do permit or suffer any act whereby the said conveyance of electrical energy may be interfered with or damaged.
