Revoking a Declaration Acquiring Land and Easement in Gross for Defence Purposes in Block V, Tiritiri Survey District in Rodney District
Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, hereby revokes the declaration dated the 5th day of November 1987 and published in the New Zealand Gazette of 26 November 1987, No. 209, page 5366, declaring land and easement in gross to be acquired for defence purposes in Rodney County (now Rodney District) pursuant to section 20 of the Public Works Act 1981.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that, an agreement to that effect having been entered into, the land described in the First Schedule and the right of way and cable easement described in the Second Schedule over the land described in the Third Schedule are hereby acquired for defence purposes and shall vest in the Crown on the date of registration of this declaration in the Land Registry Office at Auckland.

Easements
Her Majesty the Queen (hereinafter together with her heirs, successors and assigns, called “the Crown”) is the registered proprietor of the land described in the First Schedule hereto (hereinafter called “the dominant tenement”) and The Auckland Regional Council (hereinafter together with its successors and assigns, called “the owner”) is the registered proprietor of the land described in the Fourth Schedule being part of the Shakespear Regional Park (hereinafter called either “the Shakespear Regional Park” or “the park land”) over the portions more particularly described in the Third Schedule (hereinafter called “the servient tenement”) which the following described easements have been acquired with the condition that if any of the easements acquired herein should no longer be required by the Crown, then the Crown may by notice published in the Gazette either wholly or partially surrender the said easements.
Firstly
Right of Way Easement
The full, free, uninterrupted and unrestricted perpetual right for the Crown from time to time and at all times to go, pass and repass, with or without carriages, vehicles, motor vehicles, unladen or laden machinery, and implements, together with and subject to the additional rights and conditions set out herein, over the land described in the Third Schedule for the purposes of gaining access to the land described in the First Schedule.
Secondly
Cable Easement
The full, right, liberty, licence, and authority in perpetuity for the Crown to lay, construct, place, reconstruct, repair and maintain lines of cables along, under, on or over the land described in the Third Schedule hereto, and the right to convey electrical energy through the said cables with the same rights and powers set forth in the Seventh Schedule of the Land Transfer Act 1952, to convey water, together with and subject to, the additional rights and conditions set out herein.
Additional Rights and Conditions
- The right of way and cable easements shall contain the additional rights and powers set forth in the fifth paragraph of the Seventh Schedule to the Land Transfer Act 1952, and for erecting and maintaining such fixtures as may be necessary to indicate the location of the said cable or cables and the Crown may be permitted to vary the alignment of the right of way
