Amending a Declaration Declaring Stopped Road in Rodney District to be Vested

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, amends the declaration dated the 3rd day of October 1989, published in the New Zealand Gazette of the 12th day of October 1989, No. 181, page 5098, declaring stopped road in Rodney District to be vested, pursuant to section 117 of the Public Works Act 1981, by deleting from the operative clause the words “title No. 65C/5” and inserting the words “title No. 82C/12”.

Realignment of Taihape Road, Hawke’s Bay District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule hereto to be road and vested in The Hawke’s Bay District Council.

(b) Pursuant to sections 116 (1) and 117, declares the land described in the Second Schedule hereto, to be stopped and declares that:

(i) The area marked “W” on the plan, shall be amalgamated with the land in certificate of title 199/19.

(ii) The areas marked “Y” and “Z” on the plan, shall be amalgamated with the land in certificate of title 199/20.

(iii) The areas marked “AB” and “AC” on the plan, shall be amalgamated with the land in certificate of title 199/21.

(iv) The areas marked “AD”, “AE” and “AF” on the plan, shall be amalgamated with the land in certificate of title 159/123.

(v) The areas marked “AA”, “X” and “U” on the plan, shall be amalgamated with the land in certificate of title H4/240.

(vi) The land marked “V” on the plan, shall be amalgamated with the land in certificate of title 84/240, reserving however over that land marked “V”, a right of way in favour of The Hastings District Council upon the terms and conditions set out in the Fifth Schedule of the Land Transfer Act 1952, and the Ninth Schedule of the Property Law Act 1952.

(c) Declares that the land described in the Third Schedule hereto, is taken under section 119 (1) and that:

(i) The land marked “T”, “Q”, “P” and “T” on the plan, shall be amalgamated with the land in certificate of title H4/240.

(ii) The land marked “S” on the plan, shall be amalgamated with the land in certificate of title 199/19.
