Amending a Notice Realigning Road in Otorohanga District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton, hereby amends the notice dated the 13th day of March 1989, published in the New Zealand Gazette of 23 March 1989, No. 55, at page 1247, realigning road in Otorohanga District by:

(a) Deleting “memoranda of mortgage H. 807041.1, H. 565129.3, H. 565129.4 and H. 278503.1” from paragraph (b) (i) and substituting “memorandum of mortgage H. 930238.2”.

(b) Deleting “statutory land charge H. 024952, and to memoranda of mortgage H. 275247.3 and H. 494967.4” from paragraph (b) (ii) and substituting “memorandum of mortgage H. 890667.5 and statutory land charge H. 890667.6”.

Land in Hamilton City Declared to be Road

Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton, declares the land described in the Schedule hereto to be road and vested in The Hamilton City Council.

Road Realignment in Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Otorohanga District Council.

(b) Pursuant to sections 116, 117 and 119, declares the pieces of road described in the Second Schedule hereto to be stopped and the land described in the Third Schedule hereto to be taken, and further declares that:

(i) Area “T”, now known as Section 58, Block VII, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 1103, folio 141, South Auckland Land Registry.

(ii) Areas “E” and “G”, now known together as Section 42, Block III, Wharepapa Survey District, and areas “B” and “G”, now known as Sections 38 and 43, Block VII, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title, Volume 1794, folio 39, subject to memorandum of mortgage H. 108809, South Auckland Land Registry.

(iii) Area “I”, now known as Section 44, Block III, Wharepapa Survey District, shall be amalgamated with the land in certificate of title No. 29D/946, subject to section 438 of the Maori Affairs Act 1953 and to memoranda of mortgage H. 471226.2 and H.471226.3, South Auckland Land Registry.
