Water and Soil Conservation Act 1967

The Local Water Conservation (Lake Tuakitoto) Notice 1991

  1. Title and commencement—(1) This notice may be cited as the Local Water Conservation (Lake Tuakitoto) Notice 1991.

(2) This notice shall come into force on the 14th day after the date of its notification in the Gazette.

  1. Interpretation—In this notice, unless the context otherwise requires:

“Act” means the Water and Soil Conservation Act 1967.

“Lake Tuakitoto” means the variable and more or less continuous body of water commonly known as Lake Tuakitoto, including Robson's Lagoon, situated at and about map reference NZMS260 H46:650370. The shoreline of the lake is defined as the variable extent of surface water, as it is observed at any particular time.

  1. Regionally significant features—It is hereby declared that Lake Tuakitoto provides for regionally significant recreational and wildlife habitat features.

  2. Minimum lake level—The level of natural water in Lake Tuakitoto shall not be artificially lowered below 100.77 metres above datum on The Otago Regional Council gauge at the lake outlet during the period beginning 30 September in any year and ending 16 May in any following year.

  3. Water rights and general authorisations—(1) Because of the regionally significant features declared in clause 3 of this notice, no water right shall be granted under section 21 of the Act, and no general authorisation shall be made under section 22 of the Act, if the effect of any such right or authorisation would be to have a significant detrimental effect on the regionally significant recreational and wildlife habitat features of Lake Tuakitoto, or if the effect of any such right or authorisation would be that the provisions of this notice cannot remain without change or variation:
