Road Realignment in Rotorua District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Rotorua District Council.

(b) Pursuant to section 116, declares the pieces of road described in the Second Schedule hereto to be stopped.

(d) Pursuant to sections 177 and 199, declares that:

(i) Areas “C” and “B,” now known together as Section 1, S.O. 58318, shall be amalgamated with the land in certificate of title No. 19B/1315, subject to memorandum of mortgage H. 687669, South Auckland Land Registry.

(ii) Areas “D,” “E” and “E1,” now known together as Section 2, S.O. 58318, and area “H,” now known as Section 1, S.O. 58319, shall be amalgamated with the land in certificate of title No. 28A/449, subject to memorandum of mortgage H. 353028, South Auckland Land Registry.

(iii) Areas “J” and “K,” now known together as Section 2, S.O. 58319, shall be amalgamated with the land in certificate of title No. 44C/451, subject to memorandum of mortgage H. 904275.6, South Auckland Land Registry.

(iv) Areas “L” and “N,” now known as Sections 3 and 4, S.O. 58319 respectively, shall be amalgamated with the land in certificate of title No. 42C/189, subject to memorandum of mortgage H. 920972.2, South Auckland Land Registry.

(v) Areas “S” and “T,” now known as Section 1, S.O. 58320 and Section 1, S.O. 58321 respectively, shall be incorporated in deferred payment licence D.P. F. 1185 reorded in register book No. 20D/860, held from Her Majesty the Queen by Richard James Trott of Ngongotaha, farmer, subject to memoranda of mortgage H. 788270.1, H. 778270.2, H. 119527.4 and H. 552172.8, South Auckland Land Registry.

(vi) Area “W” is to be added to the adjoining land held for State forest.
