Land and Easement Acquired in Hastings District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Napier, declares that an agreement to that effect having been entered into:

(i) the land described in the First Schedule is taken for the purposes of the Conservation Act 1987 and shall vest in the Crown on the date of publication in the Gazette, and

(ii) an easement in gross (right of way) is acquired for the purposes of the Conservation Act 1987 (and may be surrendered at any time by notice in the Gazette) vesting in the Crown on the date of publication in the Gazette the full and free right in perpetuity for the Crown, its servants, agents, contractors, licensees, permit and concession holders and all others on their behalf, together with any other person entitled to use the Kaweka Forest Park to enter the land described in the Second Schedule. The rights and powers implied in the Seventh Schedule to the Land Transfer Act 1952 and the Ninth Schedule to the Property Law Act 1952 apply except that the Crown shall at its expense form and maintain the right of way to a standard adequate for its requirements.

Land at Ngakawau Bridge, Acquired for Purposes of a Road

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Christchurch, declares that an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for the purposes of a road which pursuant to section 60 (2) of the Transit New Zealand Act 1989 forms part of State Highway No. 67 and shall vest in the Crown on the date of publication of this declaration in the Gazette.
