Declaring Land and a Right of Way Easement in Gross at Te Kawa to be Acquired for Railway Purposes

Pursuant to sections 24 and 30 of the New Zealand Railways Corporation Act 1981 and section 20 of the Public Works Act 1981, the Chief Executive of the New Zealand Railways Corporation hereby declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for and on behalf of Her Majesty the Queen for railway purposes, and an easement in gross of a right of way over the land described in the Second Schedule hereto, containing the rights and powers set forth in clause 1 of the Seventh Schedule to the Land Transfer Act 1952 is hereby acquired for and on behalf of Her Majesty the Queen for railway purposes.

Pursuant to section 20 (1) of the Public Works Act 1981 and to section 88 (2) of the Transit New Zealand Act 1989, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Auckland, declares that, the land described in the Schedule is acquired, subject to the lands fifthly and thirtiethly described to the water easement created by operation of section 90A of the Land Transfer Act 1952 and transfer B. 270118.1 as shown on easement certificate B. 228827.9, North Auckland Land Registry, for a limited access road which becomes road, limited access road and State highway and which shall vest in the Crown on the date of publication in the Gazette.
