Transport Act 1962

The Traffic (Grey District) Notice No. 3, 1990

Pursuant to the Transport Act 1962, a delegation from the Minister of Transport, and a subdelegation from the Secretary for Transport, I, Carne Maurice Clissold, Controller Road and Traffic Standards, give the following notice:

This notice may be cited as the Traffic (Grey District) Notice No. 3, 1990.

In the notice the Traffic (Grey District) No. 1, 1990, signed on the 3rd day of September 1990*, under the First and Second Schedules where it states "At Kaitaia" is replaced with "At Kaiata".

Transport Services Licensing Act 1989

Ministerial Directive to Transit New Zealand

  1. The Government has decided that the passenger Transport regime introduced by the Transport Services Licensing Act 1989 and the Transit New Zealand Act 1989, will go ahead as planned. However, it believes that a smooth transition to the new regime is required to maximise national economic and social benefits.

  2. The Government wishes to see this transition effected through the procedures administered by Transit New Zealand under the Transit New Zealand Act. Accordingly, I direct Transit New Zealand, in accordance with Section 7 of the Transit New Zealand Act 1989, to include in any competitive pricing procedure approved by the Authority for passenger services, transitional provisions which will allow regional councils to give preference to existing operators in the awarding of contracts for subsidised passenger services. These transitional provisions shall be subject to the conditions set out in paragraphs 3 to 8 of this Directive.

  3. Any competitive pricing procedure approved by Transit New Zealand for passenger transport services shall contain an upper limit on the amount by which contracts let to existing operators may exceed the lowest priced bid received for the provision of a passenger service or services. This upper limit will be as followsβ€”

    (a) For contracts let during the period 1 February 1991 to 30 June 1992, inclusive, contracts let to existing operators may exceed the lowest priced bid received by a maximum of 25 percent of that lowest priced bid;

    (b) For contracts let during the period 1 July 1992 to 30 June 1993, contracts let to existing operators may exceed the lowest priced bid by a maximum of 12.5 percent of that lowest priced bid.

  4. An existing operator shall be defined as an operator who was providing the same or reasonably comparable passenger services to those being tendered, on 1 November 1990.

  5. Contracts awarded for passenger services affected by this directive shall be distributed such that the resultant expiry dates are reasonably spaced.

  6. The Competitive Pricing Procedures shall be designed to ensure that the transitional provisions are equitably applied, and do not allow regional councils to favour particular operators in the selection of the duration of contracts.

  7. The transitional provisions shall not be mandatory. The decision to adopt the provisions will lie solely with regional councils.

  8. Transit New Zealand may make such other amendments to any competitive pricing procedure for passenger services as it sees fit in order to allow this transition to be effected.

Approval of Traffic Improvement Schools

Pursuant to section 48 (2) (a) of the Transport (Vehicle and Driver Registration and Licensing) Act 1986; and

Under powers delegated to me by the Secretary for Transport in an instrument of delegation dated the 31st day of August 1990; I, Warren Richard Gillespie Simeon, Controller Road User Standards, hereby approve the following organisations or instructors for the purpose of conducting courses pursuant to regulations 11 (1) (b) (i) and 32 (2) of the Transport (Drivers Licensing) Regulations 1987:

Darryl Harwood Traffic Improvement School, Palmerston North; under the direction of Darryl Harwood.

Command Driving School, Gore; under the direction of J. A. McGowan.

Stan Hood Traffic Improvement School, Wanganui; under the direction of Stan Hood.

Approval of Motorcycle Driving Courses

Pursuant to section 48 (2) (b) of the Transport (Vehicle and Driver Registration and Licensing) Act 1986; and

Under powers delegated to me by the Secretary for Transport in an instrument of delegation dated the 31st day of August 1990; I, Warren Richard Gillespie Simeon, Controller Road User Standards, hereby approve the following courses of motorcycle instruction:

The course of Basic Motorcycle Instruction for the purposes of regulation 27 (1) (c) of the Transport (Drivers Licensing) Regulations 1987;

The course of Core Motorcycle Instruction for the purposes of regulation 30 (5) of the Transport (Drivers Licensing) Regulations 1987;

The course of Advanced Motorcycle Instruction for the purposes of regulation 32 of the Transport (Drivers Licensing) Regulations 1987;

to be conducted by the following approved school of instruction:

Stephens Driving School, Lower Hutt; under the direction of Barry Stephens.
