Land Declared to be Limited Access Road and Land Taken in the District of New Plymouth

Pursuant to the Public Works Act 1981 and to a delegation from the Minister of Lands, the Acting District Manager, Department of Survey and Land Information, New Plymouth, declares:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule hereto to be limited access road, which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, has become road, limited access road and State highway and shall remain vested in the Crown.

(b) Declares the land described in the Second and Third Schedules to be taken under section 119 (1) and declares that, pursuant to section 120 (3):

(i) The areas described in the Second Schedule, now known as Section 2, S.O. 13162, subject as to the land described firstly to a grant of right to convey gas created by transfer 368940, shall be amalgamated with the land in certificate of title, No. H3/1059, subject to memoranda of mortgage 361820.4 and 361820.5.

(ii) The areas described in the Third Schedule, now known as Section 2, S.O. 13162, subject as to the land described secondly to a grant of right to convey gas created by transfer 368940, shall be amalgamated with the land in certificate of title, No. H3/1057, subject to memorandum of mortgage 364978.
