The Ruapehu District Council (Late Nominations) Validation Order 1989

ORDER IN COUNCIL
At Wellington this 18th day of September 1989
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL
Whereas—
(a) An election of members of the Ruapehu District Council and of the Council’s Community Boards is due to be held on the 14th day of October 1989; and
(b) Section 12 (4) of the Local Elections and Polls Act 1976 requires, in the case of that election, that the nomination papers and the consents be lodged with or given to the Returning Officer not later than noon on the 1st day of September 1989 (which was nomination day); and
(c) The nomination papers and consents with respect to some of the persons nominated as candidates at that election were, through inadvertence, not lodged with the Returning Officer until after noon on nomination day; and
(d) It is desirable to validate the lodging after the time required of those nomination papers and consents:
Now therefore, pursuant to section 122 of the Local Elections and Polls Act 1976, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
Order
- Title and commencement—(1) This order may be cited as the Ruapehu District Council (Late Nominations) Validation Order 1989.
(2) This order shall come into force on the day after the date of its publication in the Gazette.
- Validation of late lodgement of nomination papers and consents—The lodging with the Returning Officer of the Ruapehu District Council, after the time required by section 12 (4) of the Local Elections and Polls Act 1976, but before midnight on the 1st day of September 1989, of the nomination papers and consents described in paragraph (c) of the Preamble to this order is hereby validated.

The Portage Licensing Trust (Notice of Election) Validation Order 1989

ORDER IN COUNCIL
At Wellington this 18th day of September 1989
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL
Whereas—
(a) The Green Bay/Titirangi Ward member of the Portage Licensing Trust died in October 1987; and
(b) The Portage Licensing Trust filled the extraordinary vacancy so created by making an appointment under section 51 of the Local Elections and Polls Act 1976 (as applied by section 16 (4) of the Licensing Trusts Act 1949); and
(c) By virtue of section 16 (6) of the Licensing Trusts Act 1949 (as inserted by section 12 of the Local Government Amendment Act 1986), the appointed member holds office until the next triennial election, when the vacancy is to be filled as if it were an ordinary vacancy; and
(d) Public notice of the vacancy was required by section 11 of the Local Elections and Polls Act 1976 (as amended by section 3 (1) of the Local Elections and Polls Amendment Act 1988) to be given by a Returning Officer not less than 70 clear days before the 14th day of October 1989, the day fixed by law for the next triennial general election; and
(e) Public notice of the vacancy, in form 2 in the First Schedule to the Local Elections and Polls Act 1976, was published, after the time required by section 11 of that Act in that it was published in the Auckland Star on the 17th day of August 1989 and in The New Zealand Herald on the 18th day of August 1989; and
(f) It is desirable to validate the publication of that public notice after the time required:
Now therefore, pursuant to section 122 of the Local Elections and Polls Act 1976, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
Order

Pursuant to section 36 of the Queen Elizabeth the Second Arts Council of New Zealand Act 1974 (as subsequently amended under section 3 in 1977), I hereby designate the Huttly Borough Council to be the administrative local authority for the Huttly Community Arts Council.
