Road Realignment in Taupo District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road which shall vest in The Taupo District Council.

(b) Pursuant to section 119 (1), declares the land described in the Second Schedule hereto to be taken.

(c) Pursuant to section 116, declares the road described in the Third Schedule hereto to be stopped.

(d) Pursuant to sections 117 and 119 (1) declares that:

(i) The areas of land taken firstly to fourthly described in the Second Schedule hereto together with the area of stopped road firstly described in the Third Schedule hereto now known as Section 34, Block XII, Atiamuri Survey District, and the area of stopped road thirdly described in the Third Schedule hereto now known as Section 36, Block XVI, Whakamaru Survey District, shall be amalgamated with the land in certificate of title No. 17D/664, subject to memoranda of mortgage H. 426943.2, H. 601572.1, and H. 254871.2, South Auckland Land Registry.

(ii) The area of stopped road secondly described in the Third Schedule hereto now known as Section 3, S.O. 52519 shall be incorporated in deferred payment licence DPF 1957 recorded in the register book No. 23D/662 held from Her Majesty the Queen by Clyde Edward George Fraser of Taupo, farmer, subject to memoranda of mortgage H. 404105.6 and H. 637334, South Auckland Land Registry.

(iii) The area of stopped road fourthly described in the Third Schedule hereto together with the area of land taken fifthly described in the Second Schedule hereto now known as Section 1, S.O. 52519 shall be incorporated in deferred payment licence DPF 1280 recorded in register book No. 20D/726, held from Her Majesty the Queen by Bryden Ellis Lane of Tirohanga, farmer and Gertrude Helen Lane of Tirohanga, farmer, in equal shares, subject to statutory land charge H. 011082 and memoranda of mortgage H. 237676.2 and H. 493044.4, South Auckland Land Registry.

(iv) The area of stopped road lastly described in the Third Schedule hereto together with the area of land taken lastly described in the Second Schedule hereto now known as Section 2, S.O. 52519 shall be dealt with as Crown land subject to the Land Act 1948.

Road Realignment in Waiapu County

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands, Gisborne, declares that, an agreement to that effect having been entered into, the land described in the Schedule is acquired for road, which pursuant to section 11 (1A) of the National Roads Act 1953, shall form part of State Highway No. 35 and shall vest in the Crown on the date of publication in the Gazette.
