Local Government Amendment Act (No. 2) 1989

The Local Government (West Coast Region) Reorganisation Amendment Order 1989

Present:
The Rt. Hon. Geoffrey Palmer presiding in Council

Pursuant to section 63 of the Local Government Amendment Act (No. 2) 1989, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O r d e r

  1. Title and commencement—This order may be cited as the Local Government (West Coast Region) Reorganisation Amendment Order 1989 and shall be read together with and deemed part of the Local Government (West Coast Region) Reorganisation Order 1989* (hereinafter referred to as “the principal order”).

(2) Subject to subclause (3) of this clause, this order shall come into force on the 1st day of November 1989.

(3) Those provisions of this order necessary to provide for the first election of the members of the local authorities, and the members of the community boards for the communities, constituted by the principal order shall come into force on the making of this order.

  1. Constituencies—(1) Clause 11 (2) (a) of the principal order is hereby amended by omitting the expression “S.O. Plan No. 14481” and substituting the expression “S.O. Plan No. 11482”.

(2) Clause 11 (2) (b) of the principal order is hereby amended by omitting the expression “S.O. Plan No. 14482” and substituting the expression “S.O. Plan No. 11487”.

  1. First election—Clause 13 of the principal order is hereby amended by revoking subclause (1) and substituting the following subclause—

“(1) For the purposes of the first election of the West Coast Regional Council—

“(a) The returning officer for the Buller Constituency and the Lyell Constituency shall be the returning officer for the Buller County; and

“(b) The returning officer for the Grey Constituency shall be the returning officer for the Grey County; and

“(c) The returning officer for the Westland Constituency shall be the returning officer for the Hokitika Borough.”

  1. Constitution of Buller District—Clause 33 of the principal order is hereby amended by omitting the expression “S.O. Plan No. 14451” and substituting the expression “S.O. Plan No. 11484”.

  2. Wards—Clause 36 (2) of the principal order is hereby amended by—

(a) Omitting from paragraph (a) the expression “S.O. Plan No. 14452” and substituting the expression “S.O. Plan No. 11468”; and

(b) Omitting from paragraph (b) the expression “S.O. Plan No. 14453” and substituting the expression “S.O. Plan No. 11467”; and

(c) Omitting from paragraph (c) the expression “S.O. Plan No. 14454” and substituting the expression “S.O. Plan No. 11469”.
