"The Board" means the Wanganui Harbour Board constituted under the Harbours Act 1950:

"Foreshore" means such parts of the bed, shore, or banks of tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of Control—There is hereby granted to the Board for a period of 1 year from the 27th day of September 1987 and ending with the 26th day of September 1988 control of the foreshore described in the Schedule to this order.

  2. Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—

(a) The Governor-General, and all officers in the Government service acting in the execution of that duty, shall at all times have free ingress, passage, and egress into, over and out of the foreshore described in the First Schedule to this order, without payment.

(b) Nothing herein contained shall authorise the Board to do, or cause to be done, anything repugnant to, or inconsistent with, any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provisions of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are, or may hereafter be, in force.

(c) The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cables that are at present, or may be at any time, laid down within the said area of the foreshore.

(d) The Board may enclose any part or parts of the foreshore described in the First Schedule hereto for the purpose of holding athletic sports or games and may by bylaws fix a charge for admission to such enclosed part or parts; provided that the total number of days on which such enclosures are made shall not exceed six in any one year.

(e) Nothing herein contained shall authorise the Board to remove, or cause to be removed, any stone, sand, shingle or shells without the consent of the Minister of Conservation being first obtained.

(f) The said rights, powers and privileges may be at any time resumed by the Governor-General, without payment or any compensation whatever, on giving the Board one calendar month’s notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at, or posted to, the known address of the Board in New Zealand.

Schedule

All those areas of foreshore lying within the limits of Wanganui Harbour as defined in Gazette, 8 March 1906, page 744, and as shown on Plan MD 2925 held in the Wanganui office of the Department of Conservation excluding thereout foreshores vested in the Board by virtue of section 53 of the Wanganui Harbour Board and River Conservation Board Act 1876.

Approval of Persons Authorised to Perform Vaccinations Against Tuberculosis

Pursuant to regulation 6 (4) of the Tuberculosis Regulations 1951, the Director-General of Health hereby gives notice that the following persons, additional to those contained in the Gazette, dated 29 October 1987, No. 187, page 4917, have been approved as qualified to perform vaccinations against tuberculosis in accordance with those regulations.

Auckland Metropolitan Drainage District Amendment Order (No. 2) 1988

At Wellington this 15th day of February 1988

THE Rt Hon. DAVID LANGE PRESIDING IN COUNCIL

Pursuant to section 8 (1) of the Auckland Metropolitan Drainage Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

  1. Title and commencement—(1) This order may be cited as the Auckland Metropolitan Drainage District Amendment Order (No. 2) 1988, and shall be read together with and deemed part of the Auckland Metropolitan Drainage District Order (No. 2) 1987 (hereafter referred to as the "principal order").

(2) This order shall be deemed to have come into effect on the same day as the principal order.

  1. Determination of financial obligations—Clause 3 of the principal order is hereby revoked, and the following clause is substituted:

"3. Determination of financial obligations—The financial obligations and assessments under the Auckland Metropolitan Drainage District Act 1960 of the Waitemata City Council with respect to the land defined in the Schedules hereto shall be determined on and from 1 April 1988."
