  2. Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of creditors of any local authority affected by this scheme shall not be affected.

Charitable Trust Act 1957

Application for Approval of a Scheme

Pursuant to Part III of the Charitable Trust Act 1957, notice is hereby given that the Public Trustee as trustee of the Will of Norman James Cox, deceased, has filed in the office of the High Court at Rotorua, an application for approval of a scheme to vary the provisions relating to the William Lomis Cox Memorial Scholarships. These scholarships were established under the deceased’s will and were varied by an earlier Scheme approved in 1964. The proposed scheme will:

(1) Vary the eligibility criteria for those persons applying for scholarships.

(2) Vary the membership of the Scholarship Committee.

(3) Make minor related changes.

Copies of the Scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Rotorua, or at the Public Trust Office at Geyser Court, Hinemoa Street, Rotorua or at the Public Trust Office at the National Bank Building, The Strand Extension, Whakatane. The application has been set down for hearing in the High Court at Rotorua on the 8th day of March 1988. Any person desiring to oppose the Scheme is hereby required to give written notice of his or her intention to do so to the Registrar of the High Court at Rotorua, and to the Public Trust Office at Rotorua or Whakatane, and to the Attorney-General not less than 7 clear days before that date.

Indecent Publications Act 1963

Before the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications: Acts of Love Part II; Sex Stars’ Favourite Positions.

Hearing at Wellington on the 11th day of September 1987.

Appearances: M. J. Wotherspoon for applicant. No appearance on behalf of respondent.

Decision

These two publications were commercially imported by parcels post at Hamilton in late June 1986 and the books were seized by the Collector of Customs in Hamilton on 1 July 1986 and the Importer subsequently disputed forfeiture. The Comptroller of Customs has advised the Tribunal that due to an administrative error no further action was taken in respect of these publications until July 1987, when the books were submitted to the Tribunal prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966.

This is a soft-cover publication which proclaims on its back cover the contents to be:
