Act 1941 and a Regional Water Board constituted under the Soil Conservation Act 1967.
- Membership of Council—(1) The Regional Council shall consist of 12 members of whom:
(1) Two shall be elected by the electors of the Mangonui Constituency, comprising the districts of Mangonui County, Kaitaia Borough and Whangaroa County;
(2) One shall be elected by the electors of the Hokianga Constituency, comprising the districts of Hokianga County and Kaikohe Borough;
(3) Two shall be elected by the electors of the Bay of Islands Constituency, comprising the district of Bay of Islands County;
(4) Two shall be elected by the electors of the Whangarei Rural Constituency, comprising the districts of Whangarei County and Hikurangi Town District;
(5) Three shall be elected by the electors of the Whangarei Urban Constituency, comprising the district of Whangarei City;
(6) Two shall be elected by the electors of the Hobson Constituency, comprising the districts of Hobson County, Dargaville Borough, and Otamatea County.
(2) For the purposes of section 82 (2) of the Local Government Act 1974, in the case of those constituencies comprising two or more constituent districts the constituent authority of the first named district shall be the principal authority.
- First Election of Regional Council—(1) The first general election of the Regional Council shall be held on the 12th day of March 1988.
(2) For the purposes of arranging the first election of the Regional Council the Returning Officer for the region shall be the Secretary of the Northland Catchment Commission.
(3) The first general election of the Regional Council shall be conducted by postal vote.
(4) The Local Elections and Polls Act 1976, the Local Government Act 1974 and the Local Government (Electoral and Survey) Regulations 1986 shall, subject to any necessary modifications, apply in respect to the holding of the first general election of the Regional Council as if any reference therein to an election to fill an extraordinary vacancy were a reference to the first election of the members of the Regional Council:
Provided that the Returning Officer shall, not less than 56 clear days before the 12th day of March 1988, give notice of the election of members of the Regional Council to be held on that date and of such other matters as are required by section 11 of the Local Elections and Polls Act 1976.
- First Meeting of Regional Council—(1) The first meeting of the Regional Council shall be held not later than 15 April 1988.
(2) The Secretary of the former Northland Catchment Commission shall convene the first meeting of the Regional Council and shall preside at that meeting until the election of a Chairman.
- Chairman and Principal Administrative Officer—(1) The Chairman of the Regional Council shall have and may exercise the duties, powers and functions of the Chairman of the Northland United Council and the Northland Catchment Commission.
(2) The Principal Officer of the Regional Council shall have and may exercise the duties, powers and functions of the Principal Administrative Officers of the Northland United Council and the Northland Catchment Commission.
(3) Until the Regional Council appoints a Principal Officer the duties of the Principal Officer shall be undertaken by the Chief Executive Officer of the former Northland Catchment Commission and Regional Water Board.
- Transfer of Responsibilities—Except as otherwise provided in this order, the Regional Council, in respect of the Northland United Council and the Northland Catchment Commission, hereinafter referred to as the “former authorities”:
(1) Shall have and may exercise and be responsible for all the powers, duties, acts of authority and functions which were previously exercised or which would have been so exercised by the former authorities;
(2) Shall have and may exercise and be responsible for all liabilities, obligations, engagements and contracts which previously were, or which would have been, the responsibility of the former authorities;
(3) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against the former authorities, or which would have been the responsibility of the former authorities;
(4) Shall succeed to the bylaws of the former authorities which are applicable to the Regional Council’s circumstances and, until revoked or altered by the Regional Council, every such bylaw shall remain in force; and every bylaw which is not applicable to the Regional Council’s circumstances shall be deemed inapplicable and revoked;
(5) Shall succeed to all rates and levies, and other money payable to the former authorities.

Out-District—For the purposes of the Soil Conservation and Rivers Control Act 1941 and the Water and Soil Conservation Act 1967, that part of the Northland Catchment Area lying outside the Northland Region shall be an out-district under the jurisdiction of the Regional Council.

Committees—Subject to section 104 of the Local Government Act 1974, section 6 of the Town and Country Planning Act 1977, section 28 of the Civil Defence Act 1983, and clause 12 of this order, the Regional Council may appoint such committees as it thinks fit.

Water and Soil Committee—(1) The Regional Council shall appoint and maintain a committee to be known as “the Water and Soil Committee” or by such other name as the Regional Council may decide.
(2) Subject to section 105 of the Local Government Act 1974, the Regional Council may delegate to that committee any of its functions, rights, powers, and duties under the Soil Conservation and Rivers Control Act 1941 and the Water and Soil Conservation Act 1967 and any other matters relating to water and soil management that may from time to time arise.
(3) In addition to such persons as the Regional Council may from time to time appoint to that committee pursuant to section 104 of the Local Government Act 1974, the Regional Council shall appoint to the committee such persons, not exceeding three in number, who may from time to time be nominated by the Minister of Works and Development.
(4) The provisions of section 44 of the Soil Conservation and Rivers Control Act 1941 and section 7 of the Soil Conservation and Rivers Control Act 1948 shall, with the appropriate modifications, apply to any person appointed to the Water and Soil Committee pursuant to subclause (3) of this clause.
- Rating—(1) Subject to the provisions of section 133 of the Local Government Act 1974, the system of rating in the region shall be a capital value system.
(2) The Hikurangi Swamp Drainage Rating District and the Hikurangi Swamp Drainage District shall endure as if they had been constituted by the Regional Council.

Accounts—(1) The accounts of the Regional Council shall be kept in accordance with the provisions of the Local Government (United Council and Regional Council) Accounting Regulations 1980.

Vesting of Property—All property, real and personal.
