The Tribunal is satisfied that there is no honesty of purpose in this publication and that it is intended to exploit prurient interest and that there is no significant intent to provide, for example, a sex educational aspect in the publication. The publication consists almost entirely of photographs of male and female models engaged in sexual activity of various kinds. The publication is clearly in contravention of the guidelines expressed in Decisions 1053 and 1054 of March 1983 in that there are excessive depictions of intimacy between male and female models of a kind which could not claim for itself the cover of being educational or therapeutic. The Tribunal is satisfied that this publication is injurious to the public good and classifies it as unconditionally indecent.

Acts of Love Part II

This soft-cover publication expresses its purpose on the front cover as being:

"EROTIC USES OF SEX DEVICES to enhance all positions of the sex act. EXPLICIT PHOTOGRAPHS AND DRAWINGS that boldly illustrate 65 special acts of love"

In the course of a two page introduction the manual, if that is what it pretends to be, states:

"Three couples were chosen whose attitudes were in line with what we had in mind. Liberated from stereotyped behaviour roles, our three couples were not bound by tradition when it came to sensual pleasures. Guided only by the principle of mutual consent, they were willing to assume any sexual position or use any device that would prove pleasurable and harmless. We wanted to see what would happen if we made the entire spectrum of sexual aids and adult toys available to our couples—Would they use them? Would they enjoy them?"

The Tribunal is unanimously in agreement that there is no honesty of purpose in this publication, that it is designed, as is the previous publication Sex Stars' Favourite Positions, solely to attract the interest of the prurient and is clearly, in the Tribunal’s view, injurious to the public good. The publication does not claim (nor could it justifiably do so) that it is intended as a serious sexual educational magazine, nor is it a magazine which might come within the guidelines set out in respect of sexual manuscripts which might be available to counsellors for therapeutic counselling. The Tribunal classifies this publication as unconditionally indecent.

Private Pleasures of John Holmes; Campfire; Submissive Suck-Off; Kake 16, Sex on the Train; Kake 25, Postal Rape; Zeus 2, The Top and Bottom of One Man’s Leather Fantasy; Zeus Presents Val Martin, Odyssey Number One;

Decision

These publications were privately imported by parcels post at Hamilton and seized by the Collector of Customs in Hamilton on 15 May 1987. The Importer has subsequently disputed forfeiture and the magazines have been referred to the Tribunal prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966.

Private Pleasures of John Holmes; Campfire; Submissive Suck-Off; Kake 16, Sex on the Train; Kake 25, Postal Rape

The Private Pleasures of John Holmes, Campfire and Submissive Suck-Off can only be described as explicit hardcore homosexual pornography. The predominant purpose in the production of these magazines is clearly to display multiple sexual activity between males, including explicit oral and anal sex, and the Tribunal is satisfied that each of these publications is injurious to the public good, and accordingly classifies each of them as unconditionally indecent. The publications Kake 16, Sex on the Train, Kake 25, and Postal Rape consist of a series of drawings, one per page which outline a story sequence. Many of the drawings in the magazines portray explicit male homosexual acts including oral and anal sex, and there are some scenes featuring of sado-masochistic activities also portrayed. The Tribunal is satisfied that these two publications are injurious to the public good, and classifies each as unconditionally indecent.

Zeus 2, The Top and Bottom of One Man’s Leather Fantasy; Zeus Presents Val Martin, Leo Stone

Both of these magazines place an emphasis on leatherware and bondage of a type that the Tribunal has previously found unconditionally indecent. For example, as in Decision 1/87 of 6 January 1987 relating to the publication Fancy No. 1. The material in each of these publications is obviously aimed at the male homosexual market, but the displays of bondage and violence as between males represent in the Tribunal’s clear view a real and patent danger to the public good, as was expressed in Decision No. 1/87. The Tribunal accordingly classifies both of these publications as unconditionally indecent.

Odyssey Number One

This publication features single male models, and although there is some suggestion in the posed photographs of bondage, there is no actual restraint shown. The Tribunal is satisfied that the material portrayed in this publication would be injurious to the younger reader, and accordingly classifies it as indecent in the hands of persons under the age of 18 years.
