Land Declared to be Road, Road Stopped and Land Taken in Block XII, Greenvale Survey District, Clutha County

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road, and vested in the Clutha County Council.

(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second Schedule hereto to be stopped, and declares that:

(i) The areas marked ‘Z’ and ‘D’ on the plan shall be incorporated in Deferred Payment Licence No. 929 recorded in Register Book No. 7A/510 held from Her Majesty the Queen by Brian John Brenssell of Crookston, farmer as to a three fifth share, Joan Marion Brenssell of Crookston, married woman, Henry Terrence Brenssell of Moa Flat, farmer and Duncan Leishman Garvan of Oamaru, company manager (jointly) as to a two fifth share.

(ii) The areas marked ‘C’ and ‘G’ on the plan shall be incorporated in Deferred Payment Licence No. 1373 recorded in Register Book No. 9B/253 held from Her Majesty the Queen by Alan Clive Stewart of Greenvale, farmer, as to a one third share, Suzanne Margaret Stewart of Greenvale, married woman, as to a one third share and to the said Alan Clive Stewart and the Trustees Executors and Agency Company of New Zealand Limited (jointly) as to a one third share as tenants in common in the said shares.

(iii) The area marked ‘H’ on the plan shall be dealt with as Crown land under the Land Act 1948.

(c) Declares the land described in the Third Schedule to be taken under section 119(1) of the Public Works Act 1981, and declares that the land shall be incorporated in Deferred Payment Licence No. 929 recorded in Register Book No. 7A/510 held from Her Majesty the Queen by Brian John Brenssell of Crookston, farmer as to a three fifth share, Joan Marion Brenssell of Crookston, married woman, Henry Terrence Brenssell of Moa Flat, farmer and Duncan Leishman Garvan of Oamaru, company manager (jointly) as to a two fifth share.

Land Declared to be Road and Road Stopped in Block VIII, Waihi South Survey District, Whakatane District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Whakatane District Council.

(b) Pursuant to sections 116 and 117, declares the portion of road described in the Second Schedule hereto to be stopped and further declares the stopped road, now known as Sections 1 and 2, S.O. Plan 56616 respectively, shall be amalgamated with the land in certificate of title No. 35D/643, subject to memoranda of mortgage H.658323.1 and H.658323.2, South Auckland Land Registry.
