Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands, declares that an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for the purposes of a road on the 14th day of July 1988.

Pursuant to section 116 of the Public Works Act 1981, the Minister of Lands declares the portion of road described in the Schedule hereto to be stopped.

All that portion of road containing 23 square metres, situated in Block VIII, Rangiora Survey District, adjoining or passing through Lot 2, D.P. 19900, Lot 1, D.P. 17999 and part Rural Section 864; as shown marked “B” on S.O. Plan 16798, lodged in the office of the Chief Surveyor at Christchurch.

Easements Over Land Acquired for an Historic Reserve in the City of Napier

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor declares that, an agreement to that effect having been entered into the following easements in gross are acquired for the purposes of an historic reserve (and may be surrendered at any time by notice in the Gazette).

(a) Right to convey water over the land first described in the Schedule.

(b) Right of way over the land secondly described in the Schedule.

(c) Right to convey underground electric power together with the right in perpetuity for the Crown to do the following over the land secondly described in the Schedule (called the land).

(i) To enter the land at all times with or without machinery or vehicles;

(ii) To use, lay, repair, modify, replace all or any underground wires and associated equipment in a manner consistent with rights implied in paragraph 5 of Seventh Schedule to the Land Transfer Act 1952.

(iii) To prohibit the erection of any structure on the planting of any tree or shrub on the land.

The easements shall vest in the Crown on the 14th day of July 1988.

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Lands:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road to be vested in the Crown.

(b) Pursuant to sections 116, 117 and 120 (3), declares the road described in the Second Schedule hereto to be stopped and vested in certificate of title No. 31C/434, Wellington Land Registry, subject to memoranda of mortgage No. 475262.3 and 559525.1.

(c) Pursuant to sections 116, 117 and 120 (3), declares the road described in the Third Schedule hereto to be stopped and vested in certificate of title, Volume 424, folio 240, Wellington Land Registry, subject to memoranda of mortgage No. 053937.3, 272129.2 and 582675.1.

(d) Pursuant to section 119 (1), declares the land described in the Fourth Schedule hereto to be taken and incorporated in certificate of title, Volume 306, folio 68, Wellington Land Registry, subject to memorandum of mortgage No. 475262.3.

(e) Pursuant to section 119 (1), declares the land described in the Fifth Schedule hereto to be taken and incorporated in certificate of title No. 31C/434, Wellington Land Registry, subject to memoranda of mortgage No. 475262.3 and 559525.1.
