Land Taken and Road Stopped in Blocks I and H, Wharepapa Survey District, Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 119(1), declares the land described in the First Schedule hereto to be taken.

(b) Pursuant to section 116, declares the portions of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to sections 119(1), 117 and 120(3), declares:

(i) that the land taken firstly described in the First Schedule hereto and the stopped road firstly described in the Second Schedule hereto, now known together as Section 34, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 709, folio 154, subject to memorandum of mortgage No. H. 295369.2, South Auckland Land Registry.

(ii) that the stopped road secondly and thirdly described in the Second Schedule hereto, now known as Sections 35 and 36, Block I, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title, Volume 709, folio 150, subject to memoranda of mortgage Nos. H. 542569.2, H. 420641, H. 662369.2 and caveat H. 545848, South Auckland Land Registry.

(iii) that the areas of stopped road fourthly, fifthly and sixthly described in the Second Schedule hereto, now known as Sections 37, 39 and 42, Block I, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title No. 2D/550, subject to memoranda of mortgage Nos. H. 368328.3, H. 368328.4 and H. 429385, South Auckland Land Registry.

(iv) that the areas of stopped road seventhly and eighthly described in the Second Schedule hereto, now known as Sections 38 and 40, Block I, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title No. 166/364, subject to memorandum of mortgage No. H. 295369.2, South Auckland Land Registry.

(v) that the areas of stopped road ninthly, tenthly and eleventhly described in the Second Schedule hereto, now known as Sections 41, 43 and 44, Block I, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title, Volume 919, folio 95, subject to memorandum of mortgage No. H. 295369.2, South Auckland Land Registry.

(vi) that the area of land taken secondly described in the First Schedule hereto and the area of stopped road twelfthly described in the Second Schedule hereto, now known together as Section 35, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 707, folio 124, subject to memoranda of mortgage No. H. 106468.3, H. 268376, H. 583947.2 and statutory land charge No. H.326889, South Auckland Land Registry.

(vii) that the areas of stopped road thirteenthly and fourteenthly described in the Second Schedule hereto, now known as Sections 46 and 49, Block I, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title, Volume 709, folio 156, subject to memorandum of mortgage No. H. 603265.4, South Auckland Land Registry.

(viii) that the areas of stopped road fifteenthly, sixteenthly and seventeenthly described in the Second Schedule hereto, now known as Sections 45, 47 and 48, Block I, Wharepapa Survey District respectively, shall be amalgamated with the land in certificate of title, Volume 918, folio 258, subject to memorandum of mortgage No. S. 594556 and charge H. 483237, South Auckland Land Registry.

(ix) that the areas of land taken thirdly and fourthly described in the First Schedule hereto and the area of stopped road eighteenthly described in the Second Schedule hereto, now known together as Section 50, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 918, folio 258, subject to memorandum of mortgage No. S. 594556 and charge H. 483237, South Auckland Land Registry.

(x) that the areas of stopped road nineteenthly described in the Second Schedule hereto, now known as Section 51, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 702, folio 141, subject to memoranda of mortgage Nos. S. 594556 and H. 364695.2 and charge H. 483237, South Auckland Land Registry.

(xi) that the area of stopped road twentiethly described in the Second Schedule hereto, now known as Section 72, Block II, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 918, folio 257, South Auckland Land Registry.

Road Stopped in Block IX, Rotoma Survey District, Rotorua District

Pursuant to section 116 of the Public Works Act 1981, the Minister of Works and Development declares the portion of road described in the Schedule hereto to be stopped.

SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

All that portion of road containing 86 square metres, situated in Block IX, Rotoma Survey District, adjoining or passing through Tauatura 16A Block; as shown on M.L. Plan 20857, lodged in the office of the Chief Surveyor at Hamilton.
