Amending Declarations Taking Land for Soil Conservation and River Control Purposes and for Better Utilisation and Notices Declaring Land to be Crown Land in Blocks I, II, IV, and V, Whakatane Survey District, Whakatane County and the Borough of Whakatane

PURSUANT to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby:

(a) Amends the declaration dated 10 April 1975 published in the New Zealand Gazette of 17 April 1975, No. 34 at page 868 and registered as H. 035392, South Auckland Land Registry, declaring land taken for soil conservation and river control purposes and better utilisation and to be Crown land in Block I, Whakatane Survey District, Whakatane County by inserting after the word “taken” in the fourth line the words “subject to the pipeline easement created by Court Order S. 301562, South Auckland Land Registry”;

(b) Amends the declaration dated 22 December 1975 published in the New Zealand Gazette of 15 January 1976, No. 2 at page 77 and registered under No. S. 4067340, South Auckland Land Registry, declaring land taken for soil conservation and river control purposes and to be Crown land in Block I, Whakatane Survey District, Whakatane County by inserting after the word “taken” in the fourth line the words “subject to the water easement created by Court Order No. S. 301562, South Auckland Land Registry”;

(c) Amends the declaration dated 10 September 1968, published in the New Zealand Gazette of 10 October 1968, No. 62 at page 1768 and registered under No. 421716 declaring land taken for soil conservation and river control purposes and to be Crown land in Blocks I and II, Whakatane Survey District, Borough of Whakatane and Whakatane County;

(i) by inserting after the word “taken” in the fourth line the words “subject to the land secondly described in the First Schedule hereto to the water easement in gross created by memorandum of transfer No. S. 241458, South Auckland Land Registry”; and

(ii) by inserting in the word “First” before the word “Schedule” in the heading to the First Schedule;

(d) Amends the notice dated 21 August 1969, published in the New Zealand Gazette of 18 September 1969, No. 57 at page 1795 and registered as No. S. 458915, South Auckland Land Registry, declaring land acquired for Government works to be Crown land by inserting after the date “1948” in the fourth line the words “and subject as to the land secondly, thirdly, fourthly, fifthly and sixthly described to the pipeline easement granted by Court Order S. 301562, South Auckland Land Registry”;

(e) Amends the declaration dated 26 April 1966, published in the New Zealand Gazette of 26 May 1966, No. 31 at page 854 and registered under No. S. 421715, South Auckland Land Registry, declaring land taken for soil conservation and river control purposes by inserting after the word “taken” in the fourth line the words “subject to the water pipeline easement granted by Court Order No. S. 301562”;

(f) Amends the notice dated 6 July 1986, published in the New Zealand Gazette of 4 August 1966, No. 46 at page 1238 and registered under No. S. 353615, South Auckland Land Registry, declaring land acquired for a Government work and not required for that purpose to be Crown land, by inserting after the fourth line the words “subject as to the land firstly described to the water pipeline easement granted by Court Order No. S. 301562, South Auckland Land Registry”;

(g) Amends the notice dated 4 December 1968, published in the New Zealand Gazette of 16 January 1969, No. 1 at page 25 and registered under No. S. 438961, South Auckland Land Registry, declaring land acquired for a Government work to be Crown land by inserting after the date “1948” in the fourth line the words “subject as to the land first and secondly described to the pipeline easements granted by Court Order No. 11289, South Auckland Land Registry, and subject as to the land thirdly described to the pipeline easement granted by Court Orders 11289 and S. 301562, South Auckland Land Registry”;

(h) Amends the declaration dated 3 October 1983, published in the New Zealand Gazette of 13 October 1983, No. 167 at page 3384 and registered under No. H. 495700, South Auckland Land Registry, declaring land to be acquired for soil conservation and river control purposes in Blocks I and IV, Whakatane Survey District by inserting after the words “is hereby acquired” in the fourth line the words “subject to the land first and secondly described to the pipeline easement created by Court Orders No. 11289, S. 301561 and S. 301562, South Auckland Land Registry”;

(i) Amends the declaration dated 18 May 1983, published in the New Zealand Gazette of 26 May 1983, No. 71 at page 1650 and registered under No. H. 469571, South Auckland Land Registry, declaring land to be acquired for soil conservation and river control purposes in Blocks I, IV, and V, Whakatane Survey District by inserting after the words “is hereby acquired” in the fourth line the words “subject as to the land fourthly described to the pipeline easement created by Court Orders No. 11289, S. 301561 and S. 301562, South Auckland Land Registry”;

(j) Amends the declaration dated 21 December 1971, published in the New Zealand Gazette of 20 January 1972, No. 3 at page 123 and registered as No. S. 546364, South Auckland Land Registry, declaring land acquired for a Government work to be Crown land by inserting after the date “1948” in the fourth line the words “subject as to the land first described to the pipeline easements created by Court Orders 11289 and S. 301561, and subject as to the land secondly and thirdly described to the pipeline easements created by Court Orders 11289, S. 301561 and S. 301562, subject as to the land fourthly described to the pipeline easement created by Court Order No. 11289, and subject as to the land sixthly described to the pipeline easements created by Court Orders No. 11289 and S. 301562, all South Auckland Land Registry”.
