Amending a Declaration Taking Land for Street and for an Access Way in the Borough of Kaikohe

PURSUANT to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby amends the declaration dated the 26th day of May 1971, published in the New Zealand Gazette of 10 June 1971, No. 42, at page 1106, declaring land taken for street and for an access way in the Borough of Kaikohe pursuant to section 32 of the Public Works Act 1928, by deleting from the declaration and the heading the words “an access way” and substituting the words “a service lane”.

Declaring Road to be Stopped and Land Taken in Block I, Wharepapa Survey District, Otorohanga District

PURSUANT to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 116, declares the portions of road described in the First Schedule hereto to be stopped;

(b) Declares the land described in the Second Schedule hereto to be taken under section 119; and

(c) Pursuant to sections 117 and 119, declares the area of stopped road firstly described in the First Schedule hereto, now known as Section 30, Block I, Wharepapa Survey District, the area of stopped road fourthly described in the First Schedule hereto and the area of land taken thirdly described in the Second Schedule hereto now known together as Section 31, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 707, folio 124, subject to memoranda of mortgage No. H. 106468.3, H. 268376 and H. 585947.2 and to statutory land charge H. 326889, South Auckland Land Registry.

(d) Pursuant to sections 117 and 119, declares the area of stopped road, secondly described in the First Schedule hereto and the area of land taken firstly described in the Second Schedule hereto now known together as Section 28, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 709, folio 143, subject to memoranda of mortgage No. S. 351917, S. 600143 and H. 106478.3 and to statutory land charge H. 093779, South Auckland Land Registry.

(e) Pursuant to sections 117 and 119, declares the area of stopped road thirdly described in the First Schedule hereto and the area of land taken secondly described in the Second Schedule hereto, the area of stopped road fifthly described in the First Schedule hereto and the area of land taken fourthly described in the Second Schedule hereto now known together as Section 29, Block I, Wharepapa Survey District, shall be amalgamated with the land in certificate of title, Volume 709, folio 150, subject to memoranda of mortgage No. H. 542569.2, H. 420641 and H. 662369.2, and to caveat H. 545848, South Auckland Land Registry.
