Amending a Declaration Acquiring Land for Sewerage Disposal Purposes in the County of Kiwitea


PURSUANT to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby amends the Declaration dated the 11th day of October 1985, published in the Gazette of 17 October 1985, No. 193, at page 4486, by deleting the Second Schedule thereto and substituting the following:

“SECOND SCHEDULE”

The right as an easement and profit a prendre appurtenant to the portion of Section 1, Block XIV, Apiti Survey District, immediately adjoining Lot 2, L.T. Plan 57923 (called “the dominant land”) to enter upon the said Lot 2, L.T. Plan 57923 (called “the servient land”) for the purpose of grazing stock thereon and cutting and taking hay therefrom upon and subject to the following conditions:

(a) The owners of the dominant land shall indemnify the Council and keep it indemnified with respect to the cost of maintaining and renewing the boundary fence between the servient land and the adjoining land described as Lot 2, D.P. 31320.

(b) The Council shall not be liable for any injury to stock which may take place on the servient land.

(c) The Council shall not erect a boundary fence between the servient land and the dominant land and the owners of the dominant land shall not call on the Council to contribute towards the cost of erecting or maintaining any such fence.

(d) The Council shall use its best endeavours to ensure that any gate in the boundary fence between the servient land and the adjoining road is always closed after being opened for the purposes of the Council, but the Council shall not be liable for any loss which may be suffered by the owners of the dominant land as a result of such gate being left open, and the owners of such land shall be responsible for any damage to any such gate which may be caused by stock.

Declaring Land to be Acquired for Post Office Purposes (Microwave Station) in Kaikoura County


PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that agreements to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for post office purposes (microwave station), and shall vest in the Crown on the 1st day of May 1986.

SCHEDULE

MARLBOROUGH LAND DISTRICT

ALL that piece of land containing 2283 square metres, situated in Block XII, Kaitarau Survey District, being part S.G.R. 105A; as shown marked ‘A’ on S.O. Plan 6460T, lodged in the office of the Chief Surveyor at Blenheim.

Land Acquired for Maori Housing Purposes in the County of Manawatu


PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for Maori housing purposes and vested in the Crown on the 1st day of May 1986.

ALL that piece of land containing 1012 square metres, situated in Block XV, Rangitoto Survey District, being Lot 35, D.P. 13. All certificate of title, No. 29B/6.

Land Acquired for Maori Housing Purposes in the County of Taranaki


PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired, subject to the restrictive covenant as to buildings contained in Transfer 296688 and the fencing covenant contained in transfer 318701, for Maori housing purposes and vested in the Crown on the 1st day of May 1986.

ALL that peice of land containing 841 square metres, situated in Block II, Paritutu Survey District, being Lot 51, D.P. 12887. All certificate of title No. F4/470.
