- The boundaries of the Lawrence Pest Destruction District shall
be those specified in the Schedule hereto.

SCHEDULE
LAWRENCE PEST DESTRUCTION DISTRICT
ALL that area in the Otago Land District, Counties of Tuapeka,
Bruce, Maniototo and Silverpeaks, containing 120 000 hectares, more
or less, bounded by a line commencing at the middle of the road
bridge across the Clutha River at Beaumont and proceeding generally
southerly down the middle of the Clutha River to a point in line
with the middle of the Crook Burn; thence generally north-easterly
to and up the middle of that burn to its intersection with the southern
side of Newton Road; thence generally north-easterly along the south-
eastern sides of that road, Polsons Road and Robertson Road to
the intersection of Section 22, Block VI, Waitahuna West Survey District;
thence generally easterly along the southern side of that unnamed
road, and generally easterly and south-easterly along the southern
and south-western sides of Clarks Flat Road and the production of
the last-mentioned side to the southern side of Polsons Road; thence
generally north-easterly along the south-eastern side of Polsons Road
to the western side of State Highway No. 8, thence south-easterly
to and along the south-western side of Hylton Street and its
production to the middle of the Waitahuna River; thence generally
south-westerly down the middle of that river to a point in line with
the middle of the Stuart Stream; thence generally south-easterly up
the middle of that stream to its intersection with the north-eastern
boundary of Lot 9, D.P. 1938; thence generally south-easterly along
the north-eastern boundary of Section 28, Block VII, Table Hill Survey District; thence generally
north-easterly along the north-western sides of an unnamed road
and Sutherland Road to a point in line with the north-eastern
boundary of Section 29, Block VII, aforesaid; thence generally south-
easterly to and along the south-western side of an unnamed road
forming the north-eastern boundaries of the said Section 29 and
Sections 72 and 91, Block IV, Table Hill Survey District to the
easternmost corner of Section 91 aforesaid; thence generally westerly
along the northern side of Nugget Creek Road to the middle of
Shepherd’s Gully Stream; thence generally south-easterly down the
middle of that river and its production to the middle of the
Tokomairiro River (West Branch); thence generally north-easterly up
the middle of that river to the south-eastern side of an unnamed
road forming the generally north-eastern boundary of Section 26,
Block V, Table Hill Survey District; thence generally south-easterly
along the south-western side of that unnamed road and its production
to the south-eastern side of Fleets Road; thence generally north-
easterly along the northern side of that road to the eastern boundary
of Block X, Table Hill Survey District; thence northerly and westerly
along the eastern and northern boundaries of Block X aforesaid to
the south-western corner of Block X, Waipori Survey District; thence
northerly, generally north-easterly and easterly along the western,
north-western and northern boundaries of Block X aforesaid to the
middle of the Waipori River; thence generally northerly up the
middle of that river to the eastern boundary of Block V, Waipori
Survey District; thence northerly to and along the eastern boundary of Block
V aforesaid and the eastern boundary of Block II, Waipori Survey
District to the north-western side of Lee Flat Road; thence generally
north-easterly along that north-western side to the middle of Big
Rock Stream; thence generally up the middle of that stream to its
intersection with the generally southern boundary of Section 3, Block
X, Lee Stream Survey District; thence generally westerly along that
southern boundary and the southern boundary of Run 186C to the
eastern boundary of Section 15, Block IV, Hedgehope Survey
District; thence generally north-westerly along the south-western
boundary of Section 1 aforesaid and its production to the middle of
Deep Stream; thence generally north-westerly up the middle of
that stream to a point in line with the generally north-eastern
boundary of Run 526, Hedgehope Survey District; thence generally
north-westerly along the north-eastern boundary of Run 526
aforesaid and its production to the middle of the Taieri River; thence
generally northerly up the middle of that river to a point in line
with the middle of McKays Creek; thence generally south-westerly
to and up the middle of that creek to a point in line with the generally
south-eastern boundary of Run 658, St Abbs Survey District; thence
generally south-westerly along the south-eastern boundary of Run
658 aforesaid and its production to the middle of the Talla Burn;
thence generally south-westerly down the middle of the Clutha River; thence generally
southerly down the middle of that river to the point of
commencement, excluding therefrom the Borough of Lawrence as
described in New Zealand Gazette, 1877, page 527.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 36 of the Local Government Act 1974, His
Excellency the Governor-General, acting by and with the advice
and consent of the Executive Council, hereby makes the following
Order:

ORDER
-
Title and commencement—(1) This Order may be cited as the
Tauranga County-Te Puke Borough Boundaries Alteration Order -
(2) This Order shall come into force on the 1st day of April 1986.

Boundaries of Tauranga County and Te Puke Borough altered—
The boundaries of the district of Tauranga County and the district
of Te Puke Borough shall be altered by excluding from the district
of Tauranga County and including in the district of Te Puke Borough
those areas described in the Schedule to this Order (hereinafter
referred to in this Order as “the said areas”). Transfer of powers,
functions, and responsibilities—The Te Puke Borough Council, in
respect of the said areas:
(a) Shall have and may exercise and be responsible for all the
powers, duties, acts or authority, and functions which were
previously exercised, or which would have been so exer-
cised, by the Tauranga County Council;
(b) Shall have and may exercise and be responsible for all li-
abilities, obligations, engagements, and contracts which pre-
viously were, or which would have been, the responsibility of
the Tauranga County Council;
(c) Shall have and may exercise and be responsible for all actions,
suits, and proceedings pending by or against, or which
would have been the responsibility of the Tauranga County
Council;
(d) Shall succeed to the bylaws which are in force and which are
applicable to its altered circumstances and, until revoked
or altered by the Te Puke Borough Council, every such
bylaw shall remain in force in the said areas, and every
bylaw which cannot be restricted to the said areas shall be
deemed inapplicable and revoked by the alteration of
boundaries;
(e) Shall succeed to all rates or levies and other money payable
to the Tauranga County Council;
(f) Shall succeed to the valuation rolls, electoral rolls, and rate
records in force in the said areas, and these shall remain
in force until such rolls or records are made by the Te
Puke Borough Council, and until that time Part IX of the
Rating Act 1967 shall apply as if the district in which the
said areas were included was the district of a special pur-
pose authority and the areas from which it was formed
were constituent districts.

Vesting of Land—The corporation of the district of Te Puke
Borough shall, in respect of the said areas, have vested in it, subject
to all existing encumbrances, all land in that area vested in the
corporation of the district of Tauranga County. -
Mayor and Principal Administrative Officer—The mayor and
principal administrative officer of the Te Puke Borough Council
shall exercise the duties, powers, and functions of the chairman and
principal administrative officer of the Tauranga County Council in
respect of the said areas. -
Creditors—Subject to section 37F of the Local Government
Act 1974, the rights or interests of creditors of any district affected
by the Order shall not be affected. -
Rating—The system of rating in the said areas shall continue
to be the land value system.
