in the City of Napier

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that an agreement to that effect
having been entered into, the land described in the Schedule hereto
is hereby acquired, subject to a fencing covenant in transfer 174293,
Hawke’s Bay Land Registry, for electric works and shall vest in the
Hawke’s Bay Electric Power Board on the 6th day of March 1986.

Operations under Part IV of the Coal Mines Act 1979 in Block
VIII, Rangiriri Survey District, Waikato County

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that an agreement to that effect
having been entered into, the land described in the Schedule hereto
is hereby acquired, subject to the mining rights reserved in transfer
93548 and the water rights contained in transfer H. 366246, South
Auckland Land Registry, for coal mining operations under Part IV
of the Coal Mines Act 1979 and shall vest in the Crown on the 6th
day of March 1986.

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, the land described in the First Schedule
hereto is hereby acquired for a post office, subject to the building
restriction described in the Second Schedule.

ALL that piece of land containing 162 square metres, situated in
Block XVI, Heretaunga Survey District, being part Lot 2, D.P. 17490;

the Chief Surveyor at Napier.

SECOND SCHEDULE

THE Crown covenants with Horizon Homes Limited, at Hastings,
for the benefit of part Lot 2, D.P. 17490, balance certificate of title
K1/1046, that any development on the land in the First Schedule
(called the land) shall not exceed one storey to the intent that the
land shall forever be subject to this covenant but so that this cove-
nant shall bind the registered proprietors and occupiers for the
time being of the land (and shall not otherwise be enforceable against
the Crown and its successors in title).
