Land Declared to be Road and Road Stopped in Block X1,

Otanake Survey District, Waitomo District

PURSUANT to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Waitomo District Council.

(b) Pursuant to section 116, declares the areas of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to section 117, declares that the area marked “A” now known as Section 11, Block X1, Otanake Survey District, shall, when so stopped, be amalgamated with the land in certificate of title No. 20C/1280, subject to the building line restriction imposed by S. 150999, the drainage and incidental rights created by transfer S. 330350, to mortgage H. 450940.4 and to joint family home settlement H. 450940.5, South Auckland Land Registry.

(d) Pursuant to section 117, declares that the area marked “C” now known as Section 10, Block X1, Otanake Survey District, shall, when so stopped, be amalgamated with the land in certificate of title No. 8A/1044, subject to the water and pipeline easement created by transfer S. 392546 and to mortgage H. 090458.2, South Auckland Land Registry.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

All that piece of land containing 505 square metres, situated in Block X1, Otanake Survey District, being part Kinohaku East 4B3 Block; as shown marked “B” on S.O. Plan 52310, lodged in the office of the Chief Surveyor at Hamilton.

All those pieces of road situated in Block X1, Otanake Survey District, described as follows:

As shown on the plans marked as above mentioned and lodged in the office of the Chief Surveyor at Hamilton.

PURSUANT to sections 116 and 117 of the Public Works Act 1981, the Minister of Works and Development declares the road described in the First, Second, and Third Schedules hereto to be stopped and further declares that the said stopped road:

(i) Described in the First Schedule hereto, now known as Sections 32, 33, 35, 36, 37, Block III, Maungamangero Survey District, shall be amalgamated with the land in certificate of title No. 9C/1280, subject to memoranda of mortgage H. 360444.6, H. 495317.1, H. 360444.7 and H. 43086, South Auckland Land Registry.

(ii) Described in the Second Schedule hereto, now known as Sections 40, 41, 42, Block III, Maungamangero Survey District, shall be amalgamated with the land in certificate of title No. 17A/533; subject to section 8 of the Mining Act 1971, statutory land charge S. 509965, memoranda of mortgage No. H 041682.3, H. 381595, and variation of mortgage H. 325151, South Auckland Land Registry.

(iii) Described in the Third Schedule hereto, now known as Sections 31, 38, 39, Block III, Maungamangero Survey District, shall be amalgamated with the land in certificate of title No. 7A/29 subject to memoranda of mortgages S. 371878, H. 441374, and variation of mortgage S. 371878, South Auckland Land Registry.
