Declaring a Water Supply Easement Acquired for a State Primary School in Block X, Hukerenui Survey District, Whangarei County and Revoking a Previous Declaration
PURSUANT to the Public Works Act 1981, the Minister of Works and Development hereby revokes the declaration dated the 29th day of November 1966 and published in the Gazette, 21 December 1966, No. 82, page 2247, and deposited in the Land Registry at Auckland, No. A197170, declaring an easement over land taken for a public school in Block X, Hukerenui Survey District, Whangarei County; and, pursuant to section 20 of the Public Works Act 1981 declares that, an agreement to that effect having been entered into, a water supply easement over the land described in the First Schedule hereto, appurtenant to the land described in the Second Schedule hereto, subject to the conditions in the Third Schedule hereto is hereby acquired for a State primary school and shall vest in the Crown on the 7th day of March 1985.

THIRD SCHEDULE
NORTH AUCKLAND LAND DISTRICT

The Crown to have the full right, liberty and authority to draw, carry and convey water in free and unimpeded flow by means of a pump, holding chamber and line of water pipes and related equipment from the spring on the registered proprietor’s property through and under the land on the stipulated course and from time to time, to renew the pump holding chamber water pipes and related equipment.

The registered proprietors shall have the full right, liberty licence and authority to connect and lead from the Crown’s pressure supply during the continuance of the easement, 3 subsidiary lines of water pipes with 2 connections not exceeding 12.5 millimetres in diameter and 1 connection not exceeding 19 millimetres in diameter for the purposes of reticulating water in free and unimpeded flow to the registered proprietor’s land, being all the land comprised and described in certificates of title No. 35B/1183 and Volume 985, folio 24, North Auckland Land Registry, the location of the above described connections being agreed upon on site by the parties. Any alterations to the said connections or additional connections to be agreed upon by the parties.

The registered proprietors consent to the Crown allowing other consumers to connect into and draw water from the Crown’s water supply line during the continuance of the easement, provided that, such connections shall not restrict in any way the Crown’s or the registered proprietor’s water supply.

In the event that there is insufficient water available from the said spring for the registered proprietor’s own requirements or that of their tenants, agents or assigns the registered proprietors shall give to the Crown 4 weeks written notice to improve the registered proprietor’s supply to their satisfaction and should no such improvement be made then the registered proprietors shall have the right to cancel and extinguish the easement on giving to the Crown a further 2 weeks written notice.

The Crown may at any time on giving the registered proprietors no less than 4 weeks written notice in that behalf, surrender and extinguish the easement.

Upon surrender and extinguishment of the easement, the Crown shall have the right by entry by its servants, agents, engineers and workmen with or without any necessary vehicles, tools, implements and materials of any kind to uplift and remove the said pump, holding chamber, water pipeline and related equipment, the Crown then restoring the surface of the stipulated course on the registered proprietor’s property as nearly as possible to its former condition.

Land Acquired, Subject to and Together with Certain Rights for Maori Housing Purposes in the Borough of Kaitaia
PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired subject to and together with the rights contained in easement certificate 152389.1 for Maori housing purposes and shall vest in the Crown on the 7th day of March 1985.
