Law Practitioners Act 1982

Pursuant to section 119 of the Law Practitioners Act 1982, notice is hereby given that the New Zealand Law Practitioners Disciplinary Tribunal on the 2nd day of September 1985 ordered that the name of Kevin Patrick Murphy of Auckland, barrister and solicitor be struck off the Roll of Barristers and the Roll of Solicitors of the High Court of New Zealand, and further ordered that the said Kevin Patrick Murphy pay to the New Zealand Law Society the sum of five hundred and seventy two dollars ($572.00) in respect of costs and expenses of and incidental to the inquiry before the tribunal, and further ordered that the said Kevin Patrick Murphy pay to the Auckland District Law Society the sum of one thousand and nine hundred dollars ($1,900.00) towards the costs and expenses of and incidental to the inquiry by its district council.

Price Order No. 332 (Imported Oranges and Bananas)

PURSUANT to the provisions of the Commerce Act 1975, I, David Leigh Shroff, being duly authorised by the Secretary of Trade and Industry, hereby make the following price order:

  1. (1) This order may be cited as Price Order No. 332 and shall come into force on the 16th day of December 1985.

(2) The following Price Orders are hereby revoked. Price Orders 301, 306, 307, 310, 321, 326, 300, 325, 330*.

  1. In this order unless the context otherwise requires:

“Wholesaler” in relation to the sale of imported oranges and bananas means any person who sells these goods to a retailer.

“Retailer” means any reseller other than a wholesaler.

“Wholesale price” means the price charged by the wholesaler to the retailer of the price received by the wholesaler at auction.

APPLICATION OF THIS ORDER

  1. This order shall apply with respect to the retail sale of all imported oranges and bananas purchased from any wholesaler.

  2. Every retailer who offers or exposes any imported oranges or bananas for sale shall keep in a prominent position in such proximity to the imported oranges or bananas to which it relates as to be obviously descriptive thereof, a ticket, placard, or label on which shall be stated in legible and prominent characters the following particulars:

(a) The retail price calculated in accordance with the relevant provisions of the price order.

(b) The variety and country of origin of the oranges or bananas displayed for sale.

FIXING MAXIMUM RETAIL PRICES OF IMPORTED ORANGES AND BANANAS

  1. The maximum price that may be received or charged by a retailer for imported oranges or bananas to which this order applies shall be determined in accordance with the appropriate following subclause:

A. For sales of less than case of carton lots of imported oranges purchased by the retailer:

The amount per kilogram arrived at by dividing the sum of the following items (a) to (c) by the appropriate amount of saleable fruit per carton or case being sold:

(a) The wholesale price;

(b) Freight actually incurred into store per case or carton;

(c) 35 percent of the sum of items (a) and (b).
