Commerce Act 1975

NOTICE is hereby given of decision No. 151 of the Commerce Commission dated 4 December 1985.

By this decision the Commission consented to the proposal whereby the New Zealand Apple and Pear Marketing Board and the New Zealand Fruitgrowers Charitable Trust, through the Fruitgrowers Charitable Trust, will each acquire 50 percent of the equity capital of Fruitfed Limited subject to the conditions that:

(1) Any agency arrangement with Fruitfed would not be on terms and conditions more advantageous than those offered to other wholesalers and in particular the Board will not give Fruitfed any more favourable terms and conditions in relation to discounts or rebates, volume supply, trading terms or distribution arrangements than it offers generally to other wholesale merchants or as the case may be in the future to retailers.

(2) The Board will not allow its position in the local market for pipfruit to be used by Fruitfed, whether as an authorised agent or through the Board's interest in the company to obtain advantageous terms and conditions in relation to discounts, or rebates, volume supply, trading terms or distribution arrangements for export overruns of kiwifruit or any other fresh fruit.

(3) The Board will not use its holding in Fruitfed to limit, reduce or prevent competition in the production, supply, transportation, storage or sale of fresh apples and pears.

NOTICE is hereby given of the result of an election for an extraordinary vacancy on the Council of the Pharmaceutical Society of New Zealand.

PURSUANT to the Local Authorities Loans Act 1956, the undersigned Assistant Secretary to the Treasury, acting under powers delegated to the Secretary to the Treasury by the Minister of Finance, hereby consents to the borrowing by the local authorities, mentioned in the Schedule hereto, of the whole or any part of the respective amounts specified in the Schedule.

Revokes Declaration of Old State Highway No. 1 and Declaring New State Highway No. 1

PURSUANT to section 11 of the National Roads Act 1953, the National Roads Board's Board, acting with written approval of the Minister of Works and Development, gives notice that the State highway described in the First Schedule below is revoked, and the new route described in the Second Schedule below is declared to be a State highway, within the meaning and for the purpose of the National Roads Act 1953.

FIRST SCHEDULE

THAT section of No. 1 State Highway from Route Position 617/10.07 to Route Position 617/17.5.

SECOND SCHEDULE

FROM the intersection of Northcroft Street in the township of Waitahanui, for a distance of approximately 5.5 km southward to a point approximately 2 km north of the summit of the Hautepe Hill.

The Water Recreation (Lake Middleton) Notice 1985β€”Waitaki County Council

I, Beryl Ann Ranger, Senior Executive Officer (Harbours and Foreshores) of the Ministry of Transport, pursuant to regulation 20 (1) of the Water Recreation Regulations 1979 that power being delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, give the following notice.

NOTICE

  1. (a) This notice may be cited as the Water Recreation (Lake Middleton) Notice 1985.

(b) This notice shall come into force on the date of its publication in the New Zealand Gazette and it shall remain in force until revoked by further notice in the Gazette.

  1. Regulations 7 (1) (a) and (b), 7 (2), 8 (1) (a) and (b) and 8 (2) of the Water Recreation Regulations 1979 shall not apply to the area of water described in the Schedule during the hours of 9 a.m. to 12 noon and 2 p.m. to 6 p.m. subject to the following conditions:

(1) Notwithstanding any other provisions of this Notice, no person who is permitted by any such provision to propel or navigate a small craft at a speed through the water exceeding five knots shall do so in any manner that is likely to endanger or unduly annoy any person who is in, on, or using the water, or fishing or undertaking any recreational activity in the vicinity of the small craft.

(2) All persons in charge of a vessel or when water skiing shall adhere to and keep the provisions of all other Acts and Regulations not specifically exempted by this notice.

  1. A suitable notice as may be approved by the Regional Marine Officer, Ministry of Transport, Christchurch, shall be erected at the launching ramp.
