The Auckland Metropolitan Drainage District Order (No. 3) 1985

His Excellency the Administrator of the Government in Council

WHEREAS, pursuant to section 43 (4) of the Auckland Regional Authority Act 1963, the Auckland Regional Authority is entitled to exercise all the powers, authorities, and discretions vested in the Auckland Metropolitan Drainage Board by the Auckland Metropolitan Drainage Act 1960:

And whereas the said Auckland Regional Authority has petitioned His Excellency the Governor-General that certain land be included in the Inner Area of the Auckland Metropolitan Drainage District and that certain land be excluded from the Inner Area of the Auckland Metropolitan Drainage District;

Now therefore, pursuant to section 8 of the Auckland Metropolitan Drainage Act 1960, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

ORDER

1. Title and commencement—(1) This order may be cited as the Auckland Metropolitan Drainage District Order 1985.
   (2) This order shall come into force on the day after the date of its publication in the Gazette.

2. Inner Area extended—The boundaries of the Inner Area of the Auckland Metropolitan Drainage District are hereby altered so as to include the land described in the First, Second, Third, Fourth, Fifth, Sixth and Twelfth Schedules.

3. Areas excluded from the Inner Area—The boundaries of the Inner Area of the Auckland Drainage District are hereby altered so as to exclude the land described in the Seventh, Eighth, Ninth, Tenth and Eleventh Schedules.

FIRST SCHEDULE

ALL that area in the North Auckland Land District, City of Manukau, in Block XI, Otahuhu Survey District, bounded by a line commencing at the intersection of the western side of Hilltop Road and the northern side of Redoubt Road and proceeding across the last-mentioned road on a bearing of 156° 31' 50" to its southern side. Thence south-easterly on a bearing of 173° 02' 00" to the northern boundary of the drainage inner area as described in New Zealand Gazette, No. 32, 10 April 1975, page 811; thence westerly along that boundary and northerly along the eastern boundary of New Zealand Gazette, No. 18, 11 March 1971, page 393 and easterly along the southern boundary of New Zealand Gazette, No. 7, 10 February 1966, page 149 to the point of commencement.

SECOND SCHEDULE

ALL that area in the North Auckland Land District, City of Manukau, in Block IX, Otahuhu Survey District bounded by a line commencing at a point in the middle of Montgomerie Road 100 metres measured westerly along that middle line from a point opposite the north-western boundary of Allotment 77A Manurewa Parish. Thence south-westerly on a bearing of 194° 29' 00" for a distance of 178 metres, thence north-westerly by a right line to the easternmost point of Lot 2, D.P. 61746. Thence south-westerly, westerly, and north-westerly along the generally south-eastern, southern and south-western boundaries of the last-mentioned lot to a point due east of the south-eastern corner of a landing reserve being part Allotment 78A, Manurewa Parish.

Thence due west along a right line to that last-mentioned point and northerly and westerly along the eastern and northern boundaries of the last-mentioned Allotment to the south-eastern side of Oruarangi Road. Thence north-easterly along that roadside and its production to the middle of Montgomerie Road, thence along the boundary of the Inner Drainage Area as described in the New Zealand Gazette, No. 25 of the 21st day of March 1974, page 505 to the point of commencement.

THIRD SCHEDULE

ALL that area in the North Auckland Land District, City of Manukau, in Block IX, Otahuhu Survey District, bounded by a line commencing at the southernmost corner of Lot 50, D.P. 40948 and proceeding south-westerly along a right line across Pukaki Road to the northernmost corner of Lot 1, D.P. 31361 and along the north-western boundary of that Lot 1 to the left bank of the Pukaki Creek. Thence north-westerly generally along that left bank to the head of the Pukaki Creek and south-westerly generally along the right bank of that creek to its intersection with the south-western boundary of Lot 1, D.P. 30451. Thence north-westerly along the south-western boundary of that Lot 1 to its most western corner.

Thence north-easterly along the north-western boundary of that Lot 1 to the southern boundary of the Inner Drainage Area as described in the Third Schedule of the Drainage Board Act 1960, New Zealand Gazette, No. 19, 16 March 1961, page 422; thence easterly generally along that boundary and the boundaries of New Zealand Gazette, No. 3, 18 January 1962, page 37, New Zealand Gazette, No. 34, 25 March 1982, page 1014 and again New Zealand Gazette, No. 3, 18 January 1962, page 37, and again New Zealand Gazette, No. 32, 10 April 1975 page 811, and again New Zealand Gazette, No. 3, 18 January 1962, page 37 to the point of commencement.

FOURTH SCHEDULE

ALL that area in the North Auckland Land District, City of Manukau, in Block IX, Otahuhu Survey District, bounded by a line commencing at the southernmost corner of Lot 2, D.P. 21265 and proceeding in a westerly direction to the easternmost corner of Lot 22, D.P. 43679. Thence north-westerly along the boundary of the Inner Drainage Area as described in New Zealand Gazette, No. 3, 18 January 1962, page 37, the Third Schedule of the Drainage Board Act 1960 and New Zealand Gazette, No. 25, 21 March 1974, page 505 to the point of commencement.

FIFTH SCHEDULE

ALL that area in the North Auckland Land District, City of Manukau, in Blocks VII and XI, Otahuhu Survey District, bounded by a line commencing on the western side of Chapel Road in line with the northern side of Browns Lane, thence south-westerly along that roadside crossing all intervening roads to its intersection with the southern side of Rongomai Road which at this point is unformed.

ALL that area in the North Auckland Land District, City of Manukau, in Block XI, Otahuhu Survey District, bounded by a line commencing at the southernmost corner of Lot 2, D.P. 73933 and proceeding southerly along a right line across Thomas Road at right angles to that road to its southern side; thence easterly along that roadside to the north-western boundary of Lot 1, D.P. 47181; thence south-westerly along that north-western boundary to the north-eastern side of Boundary Road; thence north-westerly along that roadside to the westernmost corner of Lot 1, D.P. 54015; thence south-westerly along the production of the north-western boundary of that Lot 1 to the south-western side of Boundary Road; thence north-westerly along the Inner Drainage Area as described by New Zealand Gazette, No. 7, 10 February 1966, page 149, New Zealand Gazette, No. 23, 9 March 1972, page 486 and New Zealand Gazette, No. 32, 10 April 1975, page 811 to the point of commencement.

SEVENTH SCHEDULE

ALL that area in the North Auckland Land District, City of Manukau, in Block III and Block VII, Otahuhu Survey District, bounded by a line commencing at the western side of Chapel Road in line with the northern side of Browns Lane, and proceeding north-easterly along that western roadside and that roadside produced across East Tamaki Road to its western side and continuing north-easterly along that roadside crossing all intervening roads to its intersection with Whitford Road. Thence crossing Whitford Road to its north-eastern side by a right line parallel to the northern boundary of Lot 1, D.P.
